§1-1.1. Definitions and conventions.

Within these Statutes, the following definitions shall apply:

  1. A "Student Government Official" is any student holding an elected or appointed position provided for by the Student Body Constitution or these Statutes, and not explicitly defined otherwise.
  2. An "elected official" is a Student Government Official who holds any position elected in the Student Body Elections, and also includes all Senators regardless of the means by which they were selected.
  3. The terms "Senate" and "Senator" refer to the NC State University Student Senate and its members, unless otherwise noted.
  4. A "Student in Good Standing" shall be clear of any academic probation, past or present suspensions, academic integrity probation, or disciplinary probation.
  5. The term "public body" refers to student legislative bodies and committees thereof, Student Body Commissions, and the Elections Commission. 

§1-1.2. General Qualifications for Student Government Officials.

All Student Government Officials shall be chosen from the Student Body at large, provided that they have not been prohibited from service following removal from office. The Student Body Auditor, as an exception, shall be chosen from any internal or external source as deemed appropriate by the Student Body President. All Student Government Officials must be students in good standing at the time of their appointment or election, and must remain such their entire term in office. Additional qualifications for specific offices may be assigned by these statutes.

§1-1.3. Dual Office Prohibition.

No Student Government Official may serve in more than one Student Government Office at any one time, unless such additional offices are considered Dual Office-holding Exempt (SBS §1-1.4).

§1-1.4. Dual Office-holding Exemption.

A position shall be considered dual-office holding exempt if so specified by these statutes. Furthermore, the Senate shall be empowered to grant, by Senate Resolution, a temporary dual-office holding exemption for any particular office and candidate. Such resolution must be adopted by a two thirds vote following a recommendation by the official seeking to make the appointment. At no time shall a temporary exemption be granted to an official serving in an elective office or for the purpose to serve in an elective office.

§1-1.5. Student Government Code of Ethics.

The responsibilities of a Student Government Official shall be:

  1. to answer the needs of his or her constituent body through his or her sense of moral duty and obligation;
  2. to continually enhance and encourage collegiality among all Student Government Officials;
  3. to incorporate civic virtues and advocacy in serving the needs of NC State University and its surrounding community;
  4. to encourage programs that benefit the entire University;
  5. to lobby in an effective and ethical manner, incorporating issues that affect both the Student Body and the surrounding community;
  6. to represent Student Government and NC State University in a beneficial and respectful manner;
  7. to ensure that administrative decisions are in the best interest of the Student Body;
  8. to actively avoid conflicts of interest;
  9. to be informed of and attempt to remedy campus problems and controversies;
  10. to represent the Student Body fairly and equally; and
  11. to dutifully uphold and preserve the Student Body Constitution.

§1-1.6. Oath of office; administration of oath.

All Student Government Officials shall, upon the beginning of their term of office, take the following Oath of Office in the presence of witnesses: "I, (official’s name) do solemnly swear (or affirm) that I shall faithfully represent the interests of the Student Body of North Carolina State University, that I will dutifully uphold and preserve the Student Body Constitution, and that I will faithfully execute the office of (name of office) for the (academic year) academic year."

  1. The oath shall be administered to the Executive Officers by the outgoing Student Body Chief Justice at the earliest possible convenience after the Student Body Elections.
  2. The Student Body President shall administer the oath to all of his or her appointees.
  3. The Student Senate President shall administer the oath to all Student Senators.
  4. The Student Body Chief Justice shall administer the oath to all Judicial Board members and Judicial Assistants.
  5. Student Government Officials empowered with appointing authority shall administer the oath to each of their appointees.

§1-1.7. Common Staffs Generally.

Common staffs shall exist for the purpose of aiding the official or deliberative body served in executing its duties, especially those relating to administration. No Common Staff shall exist beyond the dissolution or vacation of the body or office served.

§1-1.8. Common Staff Eligibility.

  1. All Student Senate Committees and Student Body Commissions shall be entitled to retain common staffs.
  2. Any Student Government Official serving in an elective office or an appointed office explicitly defined in statute, but not existing within another common staff, shall be eligible to retain a common staff.

§1-1.9. Common Staff Composition.

  1. Common staffs may be comprised of both Student Government Officials and non-officials, with such title as appropriate for the staff served. All staff members must be duly enrolled students.
  2. If a common staff serves a dual office-holding exempt official, the officials within the staff shall also be considered dual office-holding exempt.
  3. At no point shall an individual student serve as staff to an official who sits on a public body as a peer to the individual, nor shall an individual serve as staff to a body that reports directly or indirectly to a body the individual is a member of.
  4. All common staffs with greater than eight (8) members shall be coordinated by a Chief of Staff, who shall be considered a Student Government Official. The staff holder may co-designate other staff members as Deputy Chiefs of Staff to signify rank and authority.

§1-1.10. Open Meeting Requirement.

All meetings of public bodies shall be open to all North Carolina State University Students, except as the closing of meetings is permitted by the General Statutes of North Carolina. Permissible reasons under state law include:

  1. To prevent the disclosure of information that is privileged or confidential according to federal, state, or local law;
  2. To prevent premature disclosure of awards;
  3. To preserve the attorney client privilege;
  4. To consider the appointment or removal of an individual to or from a non-public body;
  5. As otherwise provided for by the Student Body Statutes.

§1-1.11. Public Body Meeting Records.

All public bodies shall maintain records of their business so that a reasonable person would be able to gain a reasonable understanding of what transpired. These records shall be available upon the request of any student.

§1-2.1. Definitions and Conventions.

Within this article the following definitions and conventions shall apply:

  1. Association” refers to the UNC Association of Student Government.
  2. Delegation” refers to an NCSU Student Government Delegation to the UNCASG.

§1-2.2. Reserved for future use.

§1-2.3. Delegation Composition.

  1. The Student Government Delegation to the Association shall be comprised of the Student Body President and Student Senate President, ex-officio, and additional at-large delegates appointed by the Student Body President up to the maximum allowable by the rules of the Association, subject to the simple majority confirmation of the Senate. All delegates must serve as Student Government Officials.
  2. The Delegation shall be headed by the Student Body President, ex-officio. In the event that president cannot attend a given meeting, the Student Senate President shall head the delegation. At no time shall a non-elected official head the delegation.

§1-2.4. Alternates.

Whenever possible, Student Government shall be represented at the Association with the maximum allowable number of delegates. The Student Body President may designate an alternate to a delegate up to 24 hours prior to the meeting. The acting head of the delegation may designate an alternate to a delegate within 24 hours of a meeting. All alternates must serve in elective or statutory Student Government Offices, excluding positions on common staffs.

§1-2.5. Removal of Delegates.

The Student Senate may, by Senate Resolution, remove any at-large delegate from the delegation. No such removed delegate may be reappointed unless such is allowed under the provisions of the Resolution.

§1-2.6. Delegation Report.

No later than 24 hours prior to every Association meeting, the acting delegation head shall designate a member of the delegation to prepare a detailed written report on the events of the meeting. Such report shall be submitted to the Student Senate and the Presidential Cabinet within 72 hours of the close of the meeting.

§1-2.7. Association-related Expenses.

At no point shall the Treasurer or his or her designee allocate funds to the Association without the explicit approval of the Student Senate.
