RESOLUTION 08
A RESOLUTION TO BE ENTITLED
AN ACT TO ASSERT THE PRIVILEGES OF THE SENATE REGARDING THE APPROVAL OF THE APPOINTMENT OF STUDENT BODY REPRESENTATIVES TO THE STUDENT MEDIA AUTHORITY
WHEREAS, Article II, Section Five, Subsection L of the Student Body Constitution gives the Student Senate the power to "confirm or reject appointments of the Student Body President, by a two-thirds vote in the case of appointments to fill vacated elective offices, and by a majority vote for all other regular appointments except such minor appointments as the Student Senate shall deem proper not to require approval", and,
WHEREAS, the Student Senate has traditionally deemed appointments by the Student
Body President to fill vacated Student Body Representative seats on the Student Media Authority as a matter requiring its approval; and,
WHEREAS, the Student Body Constitution is the governing document of the Student
Body of NC State University, and all student organizations are bound by its provisions, and;
WHEREAS, to that end, the Student Media Authority Statutes, Section 1.4, state that
"No part of these Statutes may be in conflict with the provisions of the Student Body Constitution or Statutes", and,
WHEREAS, the Student Media Authority Statutes, Section 2.251, state that "In the
Event of a vacancy by a Student Body Representative, the Student Body President shall within thirty days appoint a replacement subject to approval by the Student Senate and the SMA", and,
WHEREAS,the Student Body Constitution and Statutes do not provide for approval of appointed Student Media Authority Student Body Representatives by the membership of the Authority, and
WHEREAS,the Student Body Constitution, Article II, Section Five, Subsection A
Gives the Student Senate the power to "accredit its own membership", a power nowhere therein given to the Student Media Authority; and
WHEREAS, the purpose of the membership of the Student Media Authority consisting of more Student Body Representatives than Media Heads is to provide a disinterested oversight body for Student Media; and
WHEREAS,permitting the Student Media Authority to approve its own membership clearly defeats that purpose; now, therefore be it
RESOLVED,that the NC State University Student Senate finds that
- the Student Media Authority Statutes, Section 2.251, are in conflict with the aforementioned provisions of the Student Body Constitution;
RESOLVED,that the NC State University Student Senate demands that the Student Media Authority remove all requirements in its Statutes that it be permitted to approve appointments of Student Body Representatives; and be it further;
RESOLVED,that the NC State University Student Senate requests that the Student Media Authority suggest candidates for appointment to Student Body Representative seats to the Student Body President; and, be it further
RESOLVED, that the NC State University Student Senate asks the Student Media Authority to prepare an informational packet for the Student Body President, Student Senators, and Student Media Authority candidates, to ensure that all parties involved are aware of the responsibilities of the Student Media Authority.
