GOVERNMENT BILL 83

A BILL TO BE ENTITLED

AN ACT TO REVISE CAMPAIGN FINANCES IN STUDENT GOVERNMENT ELECTIONS AS WELL AS TO PROVIDE SUBSTANTIVE CHANGE TO THE ELECTIONS BOARD APPOINTMENT PROCEDURE

WHEREAS, current election statutes do not provide specific protections against candidates exceeding spending limits prior to the campaign cycle ; and,

WHEREAS, no fiscal accountability is provided for in the period preceding the campaign cycle; and,

WHEREAS, there has been significant difficulty with the timeline of appointing the elections board; now, therefore be it

ENACTED, by the North Carolina State University Student Senate that:

Section 1. Student Body Statutes §7-6.1 Spending Limits. shall be amended by adding:

(c) all expenses incurred by a candidate with the intended purpose of benefiting an election effort shall be counted towards the said candidates spending limit regardless of when the expense was incurred.

Section 2. Student Body Statutes §7-6.2 shall read as follows:

§7-6.2. Expense Reports.

      1. Candidates must submit a campaign expense sheet (included in the Candidates Packet) at the All Candidates Meeting detailing all expenditures to date.
      2. Candidates must submit a second campaign expense sheet (included in the Candidates Packet) by 9am after the close of Elections detailing all expenditures to date.
      3. Original receipts must also be submitted.
      4. Candidates shall cease campaigning if the first campaign expense sheet has not been submitted and inspected by the Elections Board at the time of the first All Candidates meeting and may not resume campaigning until such time as the first campaign expense sheet is approved by the Elections Board.
      5. No candidate shall assume office until both campaign expense sheets have been submitted and inspected by the Elections Board.
      6. Campaign expense sheets are public records, and any individual may have access to information contained in the sheets.
      7. Falsifying information on the campaign expense sheet is punishable by the Judicial Board.

Section 3. Student Body Statutes §7-5.1 General Guidelines. shall be amended by adding:

      1. no candidate shall engage in the following activities prior to the All Candidates meeting:
      1. Posting of flyers, sandwich boards, or any other campaign advertisements.
      2. Hosting of any organized public campaigning events.

This shall not be construed to prohibit any organizational activities or meetings of a campaigns' staff.

Section 4. Student Body Statutes §7-2.1(e) shall be amended by striking "January." and inserting "September."

Section 5. This act shall take effect upon the adjournment sine die of the 2000-2001 Senate Session.
