GOVERNMENT BILL 49
A BILL TO BE ENTITLED
AN ACT AUTHORIZING THE USE OF A LINE ITEM VETO BY THE
STUDENT BODY PRESIDENT.

WHEREAS, in the past months legislation has grown in both scope and complexity, with several omnibus bills being passed; and,
WHEREAS, Article 1 Section 3 of the Student Body Constitution states, "The Student Body President shall … have the power to veto any Student Senate Act…"; and,
WHEREAS, the creation of a line item veto would allow for a far more effective executive review; now, therefore be it
ENACTED, by the North Carolina State University Student Senate that:
Section 1. Student Body Statutes §3-1 shall be amended by adding, "(e) a ‘line item veto’ refers to the veto of individual clause or groups of clauses within an article of legislation."
Section 2. Student Body Statutes §3-5 shall be struck and the following inserted:
§3-5 Vetoes of Legislation.
- The President may veto any legislation submitted to him or her by the Student Senate President within ten (10) class days of the date of receipt. The President shall submit, in writing, his or her reasons for the veto to the Student Senate President within 48 hours of the veto or next regularly scheduled Student Senate meeting, whichever occurs first.
- The President shall be authorized the use of a line item veto. The President may apply the line item veto on any legislation submitted to him or her by the Student Senate President within ten (10) class days of the date of receipt. The President shall submit, in writing, his or her reasons for the line item veto to the Student Senate President within 48 hours of the line item veto or next regularly scheduled Student Senate meeting, whichever occurs first. Each line item veto, even if on the same article of legislation, requires a separate written report by the Student Body President. A line item veto shall not:
- Make the article of legislation equivalent to the rejection of the original article of legislation by the Student Senate;
- Make the article of legislation identical with, or contrary to, an article of legislation previously decided by the Student Senate during the same session, or previously considered and still not finally disposed or within the control of the Senate;
- Reverse the effect of a clause or set of clauses in an article of legislation.
- Make the article of legislation contain incoherent wording or a wording containing no rational proposition.
- Veto a clause of an article of legislation that would not be subject to a veto by the Student Body President if that clause was a separate article of legislation;
- Use the line item veto in such a manner as it would have the effect of a full veto by the Student Body President.
- No portion of a line item vetoed act of legislation shall take effect for a period of five (5) class days following the line item veto, during which time any Student Senator may give notice, by email to all senators or notice during the Senate meeting, of intent to override. If a regular meeting of the Student Senate falls within the five day period, no notice may be given after the adjournment of the meeting. Giving notice of intent to override suspends the article of legislation from taking effect until the senator has an opportunity to make the aforementioned motion.
- Any veto and the reasons for the veto shall be made a matter of public record immediately upon their receipt by the Student Senate President. Any legislation not vetoed shall be considered enacted ten (10) class days after the date of receipt.
Section 3. This act shall be effective upon its enrollment.
