GOVERNMENT BILL 81

A BILL TO BE ENTITLED

AN ACT TO DISALLOW ENDING DEBATE BY SUSPENSION OF THE RULES

 

Short Title: Previous Question Act (Senate)

WHEREAS, in order to be an effective representative body, it is of the utmost importance that rights of Senators to debate legislation not be abridged; and,

WHEREAS, suspension of the rules to end debate before two-thirds of time allotted for debate has passed effectively abridges the rights of a Senator to debate;

now, therefore be it

ENACTED, by the North Carolina State University Student Senate that:

Section 1. Student Body Statutes, §2-1, Rule 4(e), shall be amended by adding, "This rule may not be suspended." So that Rule 4(e) reads:


" (e) Previous question. The previous question, or motion to end debate and order an immediate vote, shall be decided without debate, and shall require the consent of a two-thirds majority of the Senate. The previous question shall be out of order on the consideration of the adoption of legislation unless at least two-thirds of the time allowed for debate in both the affirmative and the negative has expired. This rule may not be suspended."

Section 2. This act shall be effective immediately upon it adoption by Senate.
