RESOLUTION 65

A RESOLUTION TO BE ENTITLED

An act to Rebuke Chancellor Marye Anne Fox for her Personnel Decisions in the Office of The Provost

Short Title: Chancellor Reprimand Act                                                                              (Public)

Sponsored by: Senators Fabricius, Palin and Pendergrass

First Reading: January 15, 2003                                                  Version Date: January 27, 2003

Referred to: Committee on Government Operations.

WHEREAS,    Chancellor Marye Anne Fox instructed Provost Stuart Cooper to solicit the resignations of or terminate the employment of Senior Vice Provost Frank Abrams and Vice Provost Bruce Mallette on Monday, January 6th; and,

WHEREAS,    Provost Cooper informed Chancellor Fox on the morning of Tuesday, January 7th that he did not agree with terminating Vice Provosts Abrams and Cooper and would not do so; and,

WHEREAS,    Chancellor Fox blatantly disregarded the desires and advice of Provost Cooper regarding his senior staff by terminating the employment of Vice Provosts Abrams and Mallette in the early afternoon of Tuesday, January 7th; and,

WHEREAS,    Provost Cooper was placed in an untenable position by Chancellor FoxÕs callous actions, and resigned the morning of Wednesday, January 8th; and,

WHEREAS,    Senior Vice Provost Abrams has faithfully served North Carolina State University and its Student Body for thirty years; and,

WHEREAS,    Senior Vice Provost Abrams has provided distinguished service and leadership in the Provosts office for almost one decade; and,

WHEREAS,    Senior Vice Provost Abrams was the driving force behind the administration compromise that brought the Holy Days Act of the 2000-2001 session of the Student Senate to a successful conclusion; and,

WHEREAS,    Vice Provost Mallette has faithfully served North Carolina State University for almost 20 years; and,

WHEREAS,    Vice Provost Mallette has fought diligently and passionately for student concerns in the office of the provost for eight years; and,

WHEREAS,    Vice Provost Mallette has been instrumental in reforming the Education Technology Fee Advisory Team, and has been extremely proactive in soliciting student involvement in the Education Technology Fee process; and,

WHEREAS,    as a direct result of Chancellor FoxÕs ill-advised actions North Carolina State University has lost the services of two student-orientated and highly effective administrators in Vice Provosts Abrams and Mallette; and,

WHEREAS,    as an additional result of Chancellor FoxÕs actions, North Carolina State University is yet again bereft of a Provost, and it is extremely unlikely that the University will attract a highly qualified candidate willing to serve under Chancellor Fox; and,

WHEREAS,    while it is technically permissible for the Chancellor to terminate Vice Provosts Abrams and Mallette, it was extremely inappropriate to do so at this juncture at the very least without a public statement specifically detailing the reasons for her actions at the time of the terminations; and,

WHEREAS,    ChancellorÕs FoxÕs purge of the ProvostÕs staff has had an extremely destabilizing effect on North Carolina State University; now, therefore be it,

RESOLVED,  that the North Carolina State University Student Senate strongly rebukes Chancellor Marye Anne Fox for her reckless and unwise actions in the termination of Senior Vice Provost Frank Abrams and Vice Provost Bruce Mallette; and be it further,

RESOLVED,  that the North Carolina State University Student Senate emphatically urges Chancellor Marye Anne Fox to work earnestly to rebuild the Office of the Provost into a model for stability, openness, and student involvement in academic governance.
