GOVERNMENT BILL 49

 

A BILL TO BE ENTITLED

An act TO RESTORE CONSTITUTIONALLY SOUND ELECTIVE REPRESENTATION FOR FIRST-YEAR STUDENTS

 

 


BE IT ENACTED,     by the North Carolina State University Student Senate that:

 

Section 1.       Student Body Statutes ¤2-1.2(a) shall be amended by striking:

 

                        or the Commission on the Fall Appointment of First-Year Senators.

 

Section 2.       Student Body Statutes ¤2-1.2(b) shall be struck.

 

Section 3.       Student Body Statutes ¤2-1.23(b) shall be amended by striking:

 

                        nominees by the Fall Appointments Commission.

 

and inserting:

 

                        elected first-year Senators by the Board of Elections.

 

Section 4.       Student Body Statutes ¤2-3.5(a) shall be struck and the following shall be inserted:

 

                        (a) first-year  undergraduate students from all Schools and Colleges Ð eleven (11);

 

Section 5.       Student Body Statutes ¤2-3.5(u) shall be amended by inserting ÒCollegeÓ after ÒFirst-YearÓ.

 

Section 6.       Student Body Statutes ¤2-3.7 shall be amended by striking: Ò(ii) appointment by the Fall Appointments CommissionÓ.

 

Section 7.       Student Body Statutes ¤2-3.8 shall be amended by striking:

           

¤2-3.8. Appointment by the Appointments Commission.

The Senate shall form a Fall Appointments Commission from its membership, which shall select freshmen and first-year graduate students for positions in the Senate. Senators to be appointed by the commission include:

(a)    all Senators representing the freshman class; and

(b)    three (3) Senator representing the Graduate School.

 

and inserting:

 

¤2-3.8 Apportionment for Fall Election

The following senators shall be elected in the Fall General Election and shall not be considered for election in the Spring General Election:

(a)    all Senators representing first-year undergraduate students; and

(b)  two (2) Senators representing first-year students in the Graduate School.

 

Section 7.       Student Body Statutes ¤2-3.9 shall be struck and the following shall be inserted:

                       

                        The Student Senate President shall appoint, no later than May 1st, at least 2 members to a select Senate committee on Fall Election Publicity.  The committee shall be charged with fully publicizing both the filing and voting of the Fall General Election.

                                   

 

Section 8.       Student Body Statues ¤7-1 shall be amended by inserting after ¤7-1.3:

 

¤7-1.4. Fall General Election.

There shall be an election occurring each September, to be known as the Fall General Election. At this election, in addition to special races added by the Senate, the members of Student Body, subject to voting eligibility, shall vote upon the election of Student Senators selected in the fall per SBS ¤2-3.8.

 

¤7-1.4. Fall General Election Timeline.

(a)    Books open: At least 10 days prior to the All Candidates Meeting.

(b)    Books close: 1 day prior to the All Candidates Meeting.

(c)    All Candidates Meeting:  Third Class Wednesday of the Fall Semester.

(d)    General Elections: Second Monday and Tuesday following the All-Candidates Meeting.

(e)    Run-Off Elections: Monday and Tuesday one week after the General Elections.

 

Section 9.       Student Body Statutes ¤7-1.12 shall be amended by adding: ÒFor the purposes of first-year Senate seats, a student shall be considered first-year if they enrolled in the University after the date of the immediate previous Fall General Election.Ó

 

Section 10.     Student Body Statutes ¤7-1.16 shall be struck, and the following inserted:

 

¤7-1.16. Filing Timelines.

(a)    In the case of the Spring General Election, the Board of Elections shall begin accepting filings for office no later than twelve (12) class days prior to the All Candidates Meeting, and stop accepting filings two (2) days prior to All Candidates Meeting, at 5:00 PM.

(b)    In the case of the Fall General Election, the Board of Elections shall begin accepting filings for office no later than ten (10) class days prior to the All Candidates Meeting, and stop accepting filings one (1) day prior to All Candidates Meeting, at 5:00 PM.

 

Section 11.     This act shall be effective upon its enrollment.
