RESOLUTION 03

 

A RESOLUTION TO BE ENTITLED

AN ACT CALLING ON NORTH CAROLINA STATE UNIVERSITY TO CLARIFY THE OFF-CAMPUS CONDUCT PROVISION OF THE CODE OF STUDENT CONDUCT

 


WHEREAS,    North Carolina State University’s foremost purpose is to serve as a public institution of higher learning; and,

 

WHEREAS,    in order to maintain the synergistic relationship between students and North Carolina State University, it is necessary that a body of rules and regulations exist governing the students’ relationship to the University; and,

 

WHEREAS,    The Code of Student Conduct was created to fill the need to govern the students’ relationship with the University; and,

 

WHEREAS,    the Code of Student Conduct attempts to regulate conduct beyond the student’s relationship with the University by stating:

 

“The University reserves the right to take necessary and appropriate action to protect the safety and well being of the campus community and to support the mission of the University. Such action may include taking disciplinary action as outlined in this Code against those students whose behavior off-campus poses a potential danger to others, to self or would otherwise disrupt the campus environment or adversely affect the University.”; and,

 

WHEREAS,    the Code of Student Conduct further comments that “The University will not routinely invoke the disciplinary process for violations of this Code which occur off-campus” which allows the Code to be subjectively enforced; and,

 

WHEREAS,    the off-campus conduct clause of the Code of Student Conduct is broad and has the express intent to be subjectively enforced; now, therefore be it

 

RESOLVED,  that the North Carolina State University Student Senate urges the university administration to significantly reduce the breadth and scope of the off-campus conduct clause the Code of Student Conduct so that it can only be applied in cases where there is an appreciable risk posed by a student to the rest of the campus community.          

 

I hereby certify that this resolution was read twice and adopted by acclamation in the North Carolina State University Student Senate, this 5th day of June 2002.
