A RESOLUTION TO BE ENTITLED
An act TO Urge the university of north carolina board of governors to audit all constituents institutions management flexibility policies and terminate any abused policy
WHEREAS, in 2001, the North Carolina General Assembly granted the University of North Carolina Board of Governors the authority to authorize management flexibility to its 16 constituent institutions; and,
WHEREAS, in 2002, the UNC Board of Governors authorized management flexibility to the Board of Trustees in order to increase the administrative efficiency of the University; and,
WHEREAS, per the request of the UNC Board of Governors, the N.C. State Board of Trustees outlined the provisions of management flexibility in the institutional plan; and,
WHEREAS, in November 2002, the Board of Trustees amended university policy to provide the Chancellor with the authority to take final action on all EPA personnel actions; and,
WHEREAS, on January 8, 2003, Chancellor Marye Anne Fox exercised her discretion by firing two of the universitys top academic administrators and EPA employees, Senior Vice Provost for Academic Affairs Frank Abrams and Vice Provost for Academic Administration Bruce Mallette; and,
WHEREAS, Chancellor Fox exercised her discretion over said firings, despite protests by the Provost and Vice Chancellor of Academic Affairs, Stuart Cooper; Abrams and Mallettes direct superior; and,
WHEREAS, the actions of Chancellor Fox have been deemed by the students and faculty of N.C. State University to be precipitous, ill-reasoned and uncivil; and,
WHEREAS, the actions of Chancellor Fox have disrupted the collegial environment at N.C. State and greatly impaired the efficiency of the university administration; and,
WHEREAS, in December 2002, UNC-Chapel Hill Chancellor James Moeser sought to reorganize he universitys legal counsel office; and,
WHEREAS, under the tenets of management flexibility, Chancellor Moeser compelled te resignation of Vice Chancellor and General Counsel Susan Ehringhaus; and,
WHEREAS, under the tenets of management flexibility, Chancellor Moeser was able to forge an agreement to pay Vice Chancellor Ehringhaus almost $320,000 for eight months of unrelated work in Washington, D.C.; and,
WHEREAS, the actions of Chancellor Moeser resulted in harsh criticism and backlash against the administration of UNC-Chapel Hill, impairing its efficiency; and,
WHEREAS, the Board of Governors Committee on Personnel and Tenure endorsed management flexibility with the stipulation that the Board
have the ability to monitor the use of such flexibility and to terminate it if it is not being appropriately exercised; and,
WHEREAS, the actions of Chancellor Fox and Moeser reflect an inappropriate exercise of management flexibility; and,
WHEREAS, continued abuse of the management flexibility provision will tarnish the Universitys public image and impair its ability to gain support from the North Carolina General Assembly; and,
WHEREAS, according to Section 600.3.4 of the Code of the University of North Carolina, the Board of Governors and the President shall conduct performance audits on policies, practices, and other matters related to management flexibility implementation and operation at constituent institutions to which this flexibility has been granted; now, therefore be it
RESOLVED, that the North Carolina State University Student Senate emphatically urges the University of North Carolina Board of Governors to conduct an immediate audit, under Section 600.3.4 of The Code of the University of North Carolina, on the management flexibility policies at each constituent institution who have had management flexibility powers granted unto them; and, be it further,
RESOLVED, that the North Carolina State University Student Senate encourages the University of North Carolina Board of Governors, upon the completion of said audit, to terminate any constituent institutions management flexibility policy which has not been appropriately exercised, as stipulated by the Board of Governors Committee on Personnel and Tenure.
