GOVERNMENT BILL 80
A BILL TO BE ENTITLED
An Act to Provide Additional Procedural Clarity on issue of confirmation of Appointments
WHEREAS, the Student Senate must confirm dozens of appointments each session, well beyond the capacity of thorough review on the Senate floor; and,
WHEREAS, thorough review of appointments is necessary to ensure appointees have an understanding of their duties and are of solid character and ability; and,
WHEREAS, several ambiguities exist in the procedure for confirmation that can result in delay or confusion; now, therefore be it
ENACTED, by the North Carolina State University Student Senate that:
Section 1. Student Body Statutes §2-1.24 shall be amended by inserting:
(b) Introduction of Confirmation Resolutions. Upon notice to the Senate President per part (a) of an appointment external to the Student Senate, a Senate Resolution bearing no sponsor shall be automatically introduced providing for the confirmation of the individual appointment. This Senate Resolution shall be considered on first reading and referred to committee, notwithstanding fast-track, as provided by rule.
Section 2. Student Body Statutes §2-1.24(b) shall be amended by adding “Consideration of the an appointment confirmation on the Senate floor shall proceed by the same manner regardless if a simple motion is under consideration or a confirmation resolution is on second reading.”
Section 3. Student Body Statutes §2-1.24 shall be amended by inserting:
(c) Affect of Committee Reports. Favorable committee reports shall affect resolutions of confirmation in the same manner as standard reports. Committees may issue provisional negative reports on confirmation resolutions, indicating likelihood that the committee will issue a full negative report in the future, and thereby suspending any acting status. In the event of a negative report on a confirmation resolution, the confirmation shall be considered defeated unless the confirmation is successfully discharged at the subsequent Senate meeting.
Section 4. Student Body Statutes §2-1.24 shall be amended by inserting:
(d) Standards of Communication It shall be the responsibility of the chair of the committee considering a confirmation motion or resolution to notify the appointee of a confirmation hearing. A reasonable attempt shall be made to accommodate the appointee’s schedule, and at least three (3) class days notice shall be given.
Section 5. Student Body Statutes §3-1 shall be amended by inserting:
§3-1.6. Acting Status of Unconfirmed Appointees.
Section 6. Student Body Statutes §3-1 shall be amended by inserting:
§3-1.7. Financial Expenditures of Unconfirmed Appointees.
Unconfirmed appointed officials shall not expend funds without prior written approval of the Student Body Treasurer.
Section 7. This act shall be effective upon its enrollment.
