SENATE RESOLUTION 121

 

A RESOLUTION TO BE ENTITLED

An Act To Impeach Senator Choe On The Charge Of Neglect of Duty Due to Excessive Absences

 

Short Title: Choe Impeachment   (Senate)

WHEREAS,   Dustin Choe, a student of North Carolina State University, became a Student Senator representing Life-long Education on April 30, 2003; and,

 

WHEREAS,   the Student Body Statutes, Chapter 2, Article 1, Rule 2f, provides that the Student Senate Standing Committee on Government Operations shall review the absences of a Student Senator should the Senator accumulate four (4) absences; and,

 

WHEREAS,   the Student Body Statutes, Chapter 2, Article 1, Rule 2e, provides that absences from formal meetings of Senate committees shall be treated as one-half (1/2) a Senate absence; and,

 

WHEREAS,   as of January 15, 2004, Senator Choe has missed a total of thirteen (13) Senate roll calls or committee meetings, totaling six and half (6.5) total absences; and,

 

WHEREAS,   in a hearing conducted pursuant to rule on January 21, 2004, the Senate Standing Committee on Government Operations found the absences of Senator Choe excessive and recommended impeachment; now; therefore be it

 

RESOLVED,  that the NC State University Student Senate hereby impeaches Senator Choe on the charge of neglect of duty, as defined and authorized by sections 25 and 9(d) of Chapter 2, Article 2 of the Student Body Statutes; given the specifications:

      1. Senator Choe missed the closing roll call for the Student Senate meeting on August 27, 2003;
      2. Senator Choe missed the opening roll call for the Student Senate meeting on September 24, 2003;
      3. Senator Choe missed the closing roll call for the Student Senate meeting on September 24, 2003;
      4. Senator Choe missed the closing roll call for the Student Senate meeting on October 15, 2003;
      5. Senator Choe missed the opening roll call for the Student Senate meeting on October 22, 2003;
      6. Senator Choe missed the closing roll call for the Student Senate meeting on October 22, 2003;
      7. Senator Choe missed the opening roll call for the Student Senate meeting on October 29, 2003;
      8. Senator Choe missed the closing roll call for the Student Senate meeting on October 29, 2003;
      9. Senator Choe missed the closing roll call for the Student Senate meeting on November 12, 2003;
      10. Senator Choe missed the closing roll call for the Student Senate meeting on December 3, 2003;
      11. Senator Choe missed the opening roll call for the Student Senate meeting on January 14, 2004;
      12. Senator Choe missed the closing roll call for the Student Senate meeting on January 14, 2004;
      13. Senator Choe missed the Campus Community Committee meeting on October 22, 2003;

 

I hereby introduce the above resolution for reading in the NCSU Student Senate, pursuant to Student Body Statues §2-2.9(d) and on order of the Committee on Government Operations, this 2nd day of February 2004.
