GOVERNMENT BILL 152

 

A BILL TO BE ENTITLED

An act to codify and regulate the student fee review process

 


BE IT ENACTED,     by the North Carolina State University Student Senate that:

 

Section 1.        Chapter 2 of the North Carolina State University Student Body Statutes be amended by adding Article 4 as follows:

 

Article 4. Student Fee Review Process.

 

§2-4.1. Fee Group Definition.

Within this article, “fee group” shall be defined as any university unit or auxiliary unit with administrative control of the use of a student fee.

 

§2-4.2. Purpose.

The purpose of the fee increase review process is to review all proposed fee increases from fee groups and give the student body’s recommendations on said increases.  The review process promotes transparency and accountability for fee groups concerning student fee dollars.

 

§2-4.3. Review Process Documents.

(a)     Budgets.  The Student Senate Tuition and Fee Committee requires certain documents in order to complete the fee increase review process.  A three-year budget, beyond the budget given per the University Budget Office, with clear and understandable numbers shall be requested from each fee group.  Budgets should show where money would be spent with and without a fee increase.

(b)     Justifications.  Budgets should be accompanied by documentation of pertinent student programs and activities that will gain or lose funding and the reasoning therefore, either in the case of an increase or of no increase.  Justifications should be in a clear and concise document and accompany the increase presentation.

 

§2-4.4. Fee Review Timeline.

The follow timeline shall be observed during the review of fee proposals:

(a)     Information Request. No later than the fifth class day of the fall semester.

(b)     Committee Fee Presentations. Concluded by the first Friday in October.

(c)     Initial Committee Recommendations. At least three weeks prior to the scheduled Senate Consideration.

(d)     Senate Consideration. On a date determined by the Senate President no later than the first week in September.

 

§2-4.5. Information Request.

The Chair of the Tuition and Fees Committee shall request from the Budget Office and the Office of the Vice Chancellor for Student Affairs a list of all fee groups who are requesting a fee increase and their corresponding increase amount. When this information is received, the Chair or his designee shall contact the administrators the fee groups and seek the full review process document. All information shall be distributed to the committee.

 

§2-4.6. Committee Fee Presentations.

The Chair of the Tuition and Fees Committee shall schedule a presentation of each fee group with fee increase proposal(s), accommodating the groups as much as feasible. Ordinarily, each fee group will have a period of twenty (20) minutes to present and of at least twenty (20) minutes for questions and answers.

 

§2-4.7. Initial Committee Recommendations.

The Tuition and Fees Committee shall make a preliminary recommendation concerning each fee increase, and identify any residual questions to ask the fee groups. Insomuch as possible, these questions shall deal with technical issues about fee increases. The committee shall take such action necessary to ensure introduction of resolutions concerning each fee increase.

 

§2-4.8. Final Committee Recommendations.

Prior to issuing a final report on a fee increase, the Tuition and Fee Committee shall ask any clarifying questions about fee increases to the fee groups. Such questions may be asked either by communication with or the presence of fee groups.

 

§2-4.9. Senate Consideration.

During any Senate meeting at which fee increase recommendations are scheduled for consideration during second reading, a period of forty-five (45) minutes of student comments on fee increases shall follow the initial comments and announcements period. During second reading of a fee increase related resolution, the relevant fee group shall be given ten (10) minutes after the sponsors report to answer technical questions about the fee increases.

 

§2-4.10. Executive Session Restriction.

At no time shall it be in order for the Senate or Tuition and Fees Committee to enter in closed session for any portion of the fee review process.

 

§2-4.11. Suspension of Article.

No provision of this article shall be subject to suspension.

 

Section 2.        This act shall be effective upon its enrollment.
