A RESOLUTION TO BE ENTITLED

An Act To Impeach Senator Rice On The Charge Of Neglect of Duty Due to Excessive Absences

WHEREAS,   Charles Rice, a student of North Carolina State University, became a Student Senator representing College of Humanities and Social Sciences Sophomores on April 23, 2003; and,

 

WHEREAS,   the Student Body Statutes, Chapter 2, Article 1, Rule 2f, provides that the Student Senate Standing Committee on Government Operations shall review the absences of a Student Senator should the Senator accumulate four (4) absences; and,

 

WHEREAS,   the Student Body Statutes, Chapter 2, Article 1, Rule 2e, provides that absences from formal meetings of Senate committees shall be treated as one-half (1/2) a Senate absence; and,

 

WHEREAS,   as of January 15, 2004, Senator Rice has missed a total of seventeen (17) Senate roll calls or committee meetings, totaling eight and a half (8.5) total absences; and,

 

WHEREAS,   in a hearing conducted pursuant to rule on January 21, 2004, the Senate Standing Committee on Government Operations found the absences of Senator Rice excessive and recommended impeachment; now; therefore be it

 

RESOLVED,  that the NC State University Student Senate hereby impeaches Senator Rice on the charge of neglect of duty, as defined and authorized by sections 25 and 9(d) of Chapter 2, Article 2 of the Student Body Statutes; given the specifications:

      1. Senator Rice missed the opening roll call for the Student Senate meeting on August 27, 2003;
      2. Senator Rice missed the closing roll call for the Student Senate meeting on August 27, 2003;
      3. Senator Rice missed the opening roll call for the Student Senate meeting on October 15, 2003;
      4. Senator Rice missed the closing roll call for the Student Senate meeting on October 15, 2003;
      5. Senator Rice missed the opening roll call for the Student Senate meeting on October 22, 2003;
      6. Senator Rice missed the closing roll call for the Student Senate meeting on October 22, 2003;
      7. Senator Rice missed the opening roll call for the Student Senate meeting on October 29, 2003;
      8. Senator Rice missed the closing roll call for the Student Senate meeting on October 29, 2003;
      9. Senator Rice missed the closing roll call for the Student Senate meeting on November 12, 2003;
      10. Senator Rice missed the opening roll call for the Student Senate meeting on December 3, 2003;
      11. Senator Rice missed the closing roll call for the Student Senate meeting on December 3, 2003;
      12. Senator Rice missed the opening roll call for the Student Senate meeting on January 14, 2004;
      13. Senator Rice missed the closing roll call for the Student Senate meeting on January 14, 2004;
      14. Senator Rice missed the University Affairs Committee meeting on August 24, 2003;
      15. Senator Rice missed the University Affairs Committee meeting on October 2, 2003;
      16. Senator Rice missed the University Affairs Committee meeting on October 28, 2003; and
      17. Senator Rice missed the University Affairs Committee meeting on November 5, 2003.

 

I hereby introduce the above resolution for reading in the NCSU Student Senate, pursuant to Student Body Statues §2-2.9(d) and on order of the Committee on Government Operations, this 2nd day of February 2004.
