A RESOLUTION TO BE ENTITLED

An Act To Impeach Senator Shultz On The Charge Of Neglect of Duty Due to Excessive Absences

 

Short Title: Shultz Impeachment   (Senate)

WHEREAS,   Matthew W. Shultz, a student of North Carolina State University, became a Student Senator representing College of Management Juniors on April 23, 2003; and,

 

WHEREAS,   the Student Body Statutes, Chapter 2, Article 1, Rule 2f, provides that the Student Senate Standing Committee on Government Operations shall review the absences of a Student Senator should the Senator accumulate four (4) absences; and,

 

WHEREAS,   the Student Body Statutes, Chapter 2, Article 1, Rule 2e, provides that absences from formal meetings of Senate committees shall be treated as one-half (1/2) a Senate absence; and,

 

WHEREAS,   as of September 29, 2003, Senator Shultz has missed a total of ten (10) Senate roll calls or committee meetings, totaling five (5) total absences; and,

 

WHEREAS,   in a hearing conducted pursuant to rule on October 1, 2003, the Senate Standing Committee on Government Operations found the absences of Senator Shultz excessive and recommended impeachment; now; therefore be it

 

RESOLVED,  that the NC State University Student Senate hereby impeaches Senator Shultz on the charge of neglect of duty, as defined and authorized by sections 25 and 9(d) of Chapter 2, Article 2 of the Student Body Statutes; given the specifications:

      1. Senator Shultz missed the closing roll call for the Student Senate meeting on April 23, 2003;
      2. Senator Shultz missed the opening roll call for the Student Senate meeting on August 27, 2003;
      3. Senator Shultz missed the closing roll call for the Student Senate meeting on August 27, 2003;
      4. Senator Shultz missed the opening roll call for the Student Senate meeting on September 10, 2003;
      5. Senator Shultz missed the closing roll call for the Student Senate meeting on September 10, 2003;
      6. Senator Shultz missed the opening roll call for the Student Senate meeting on September 24, 2003;
      7. Senator Shultz missed the closing roll call for the Student Senate meeting on September 24, 2003;
      8. Senator Shultz missed the University Affairs Committee meeting on August 24, 2003;
      9. Senator Shultz missed the University Affairs Committee meeting on September 10, 2003; and
      10. Senator Shultz missed the University Affairs Committee meeting on September 21, 2003.

 

I hereby introduce the above resolution for reading in the NCSU Student Senate, pursuant to Student Body Statues §2-2.9(d) and on order of the Committee on Government Operations, this 12th day of October 2003.
