SENATE RESOLUTION 135

A RESOLUTION TO BE ENTITLED

An act to impeach senator adriadn ortega on the charges of abuse of powers, neglect of duty, and fraudulent misrepresentation on offical documents

Short Title: The Impeachment of Senator Adriadn Ortega (Public)

Sponsored by: Senators Hutcherson, Chichwak, J. Thornton, Heard, Small, and Weston

Referred to: The Committee on Government Operations.

WHEREAS, Adrian Ortega, a student at North Carolina State University, was duly reelected to serve as a Student Senator for the 84^th Session of the North Carolina State University Student Senate; now, therefore be it

RESOLVED, that the North Carolina State University Student Senate hereby impeaches Senator Adriadn Ortega on the charges of:

(a) Abuse of Power, as defined and authorized by section 24 of Chapter 2, Article 2, of the Student Body Statutes; given the specifications:

1. Senator Adriadn Ortega, while serving as the Chair of the Subcommittee on Ethics during the 84^th Session of the North Carolina State University Student Senate, had direct knowledge of student voucher theft and "chose not" to act upon that information;

(b) Neglect of Duty, as defined and authorized by section 25 of Chapter 2, Article 2, of the Student Body Statutes; given the specifications:

1. Senator Adriadn Ortega on February 1, 2005 stated to the Subcommittee on Ethics that if he saw theft of vouchers he would not turn people in;

2. Senator Adriadn Ortega deprived the Students of North Carolina State University by willfully mishandling student vouchers during there distribution;

3. Senator Adriadn Ortega on February 1, 2005, admitted to the Subcommittee on Ethics that he had taken unauthorized vouchers

(c) Fraudulent Misrepresentation on Official Documents, as defined and authorized by section 26 of Chapter 2, Article 2, of the Student Body Statutes; given the specifications:

1. Senator Adriadn Ortega submitted his resignation as a Senator to the whole Senate and then on February 1, 2005 stated to the Subcommittee on Ethics that he submitted his resignation knowing that he had no intention to actually resign.
