A RESOLUTION TO BE ENTITLED
An act TO CLARIFY STUDENT CONDUCT POLICIES AND DUE PROCESS IN UNIVERSITY HOUSING.

WHEREAS, personal web pages and blogs have become
increasingly popular among students at NCSU, increase the availability of
potentially incriminating evidence; and,
WHEREAS, the University lacks an explicit written
policy on admittance of internet-based evidence, creating a sense of ambiguity
surrounding the subject; and,
WHEREAS, when students have charges brought against
them for a potential violation of University Housing and/or Code of Student
Conduct policy there is a proper process of adjudication; and
WHEREAS, this process should treat the student as
innocent until they are proven guilty; and,
WHEREAS, the process should allow the students to
defend themselves against the charges for which they have been accused; and,
WHEREAS, during the preparation of their defense the
student should be given all the information that has been brought to the
attention of University Housing and/or the Office of Student Conduct; and,
WHEREAS, being prohibited from obtaining information
can hinder the adjudication process and make it unjust to the accused student
and;
WHEREAS, it is imperative that North Carolina State
University maintain a uniform and just process for students accused of
violating University Housing policy and/or the Code of Student Conduct; now
therefore be it
RESOLVED, that the North
Carolina State Student Senate expresses concern with University Housing and the
office of Student Conduct relating to the procedures followed when students in
Alexander Residence Hall were accused of violating university alcohol policies
based on pictures acquired from the Facebook website; and be it further
RESOLVED, that the Senate
recommends that the Office of Student Conduct and the University take efforts
to make all incoming students more aware of the Code of Student Conduct and
consequences of violations.
