SENATE RESOLUTION 88

 

A RESOLUTION TO BE ENTITLED

AN ACT To Expel Senator Barnes On The Charge Of Neglect of Duty Due to Excessive Absences

 

Short Title:  Barnes Expulsion (Senate)

WHEREAS,   Andrew Barnes, a student of North Carolina State University, was appointed a Student Senator representing the Graduate delegation in September of 2006; and,

 

WHEREAS,   the Student Body Statutes, Chapter 2, Article 1, Rule 2f, provides that the Student Senate Standing Committee on Government Operations shall review the absences of a Student Senator should the Senator accumulate four (4) absences; and,

 

WHEREAS,   the Student Body Statutes, Chapter 2, Article 1, Rule 2e, provides that absences from formal meetings of Senate committees shall be treated as one-half (1/2) a Senate absence; and,

 

WHEREAS,   as of February 18, 2007 Senator Barnes has missed a total of twenty (20) Senate roll calls or committee meetings, totaling ten (10) total absences; and,

 

WHEREAS,   in a hearing conducted pursuant to rule on January 28, 2007, the Senate Standing Committee on Government Operations found the absences of Senator Barnes excessive and recommended expulsion; now; therefore be it

 

RESOLVED,  that the North Carolina State University Student Senate hereby expels Senator Barnes on the charge of neglect of duty, as defined and authorized by §2-2.38. Expulsion for non-attendance of the Student Body Statutes; given the specifications:

 

1.      Senator Barnes missed the opening roll call for the Student Senate meeting on October 4, 2006;

2.      Senator Barnes missed the closing roll call for the Student Senate meeting on October 4, 2006;

3.      Senator Barnes missed the opening roll call for the Student Senate meeting on October 18, 2006;

4.      Senator Barnes missed the closing roll call for the Student Senate meeting on October 18, 2006;

5.      Senator Barnes missed the opening roll call for the Student Senate meeting on November 15, 2006;

6.      Senator Barnes missed the closing roll call for the Student Senate meeting on November 15, 2006;

7.      Senator Barnes missed the opening roll call for the Student Senate meeting on January 10, 2007;

8.      Senator Barnes missed the closing roll call for the Student Senate meeting on January 10, 2007;

9.      Senator Barnes missed the opening roll call for the Student Senate meeting on January 24, 2007;

10.  Senator Barnes missed the closing roll call for the Student Senate meeting on January 24, 2007;
