SENATE RESOLUTION 96

 

A RESOLUTION TO BE ENTITLED

AN ACT To Expel Senator Hicks On The Charge Of Neglect of Duty Due to Excessive Absences

WHEREAS,   Mr. Hicks, a student of North Carolina State University, was elected to Student Senate in September of 2006; and,

 

WHEREAS,   the Student Body Statutes, Chapter 2, Article 1, Rule 2f, provides that the Student Senate Standing Committee on Government Operations shall review the absences of a Student Senator should the Senator accumulate four (4) absences; and,

 

WHEREAS,   the Student Body Statutes, Chapter 2, Article 1, Rule 2e, provides that absences from formal meetings of Senate committees shall be treated as one-half (1/2) a Senate absence; and,

 

WHEREAS,   as of March 11, 2007 Senator Hicks has missed a total of thirteen (13) Senate roll calls or committee meetings, totaling six and half (6.5) total absences; and,

 

WHEREAS,   in a hearing conducted pursuant to rule on February 28, 2007, the Senate Standing Committee on Government Operations found the absences of Senator Hicks excessive and recommended expulsion; now; therefore be it

 

RESOLVED,  that the North Carolina State University Student Senate hereby expels Senator Hicks on the charge of neglect of duty, as defined and authorized by sections 38 and 9(a) of Chapter 2, Article 2 of the Student Body Statutes; given the specifications:

1.      Senator Hicks missed the opening roll call for the Student Senate meeting on November 29, 2006;

2.       Senator Hicks missed the opening roll call for the Student Senate meeting on January 24, 2007;

3.      Senator Hicks missed the closing roll call for the Student Senate meeting on January 24, 2007;

4.      Senator Hicks missed the opening roll call for the Student Senate meeting on January 31, 2007;

5.      Senator Hicks missed the closing roll call for the Student Senate meeting on January 31, 2007;

6.      Senator Hicks missed the opening roll call for the Student Senate meeting on February 7, 2007;

7.      Senator Hicks missed the closing roll call for the Student Senate meeting on February 7, 2007;

8.      Senator Hicks missed the opening roll call for the Student Senate meeting on February 21, 2007;

9.      Senator Hicks missed the closing roll call for the Student Senate meeting on February 21, 2007;

10.  Senator Hicks missed the opening roll call for the Student Senate meeting on February 28, 2007;

11.  Senator Hicks missed the closing roll call for the Student Senate meeting on February 28, 2007;

12.  Senator Hicks missed the Finance Committee meeting on November 1, 2006;

13.  Senator Hicks missed the Finance Committee meeting on November 8, 2006;
