SENATE RESOLUTION 89

 

A BILL TO BE ENTITLED

AN ACT Expel Senator Hoy On The Charge Of Neglect of Duty Due to Excessive Absences

WHEREAS,   Ken Hoy, a student of North Carolina State University, was elected a Student Senator representing the Graduate delegation in April of 2006; and,

 

WHEREAS,   the Student Body Statutes, Chapter 2, Article 1, Rule 2f, provides that the Student Senate Standing Committee on Government Operations shall review the absences of a Student Senator should the Senator accumulate four (4) absences; and,

 

WHEREAS,   the Student Body Statutes, Chapter 2, Article 1, Rule 2e, provides that absences from formal meetings of Senate committees shall be treated as one-half (1/2) a Senate absence; and,

 

WHEREAS,   as of February 18, 2007 Senator Hoy has missed a total of fifteen (15) Senate roll calls or committee meetings, totaling seven and half (7.5) total absences; and,

 

WHEREAS,   in a hearing conducted pursuant to rule on January 28, 2007, the Senate Standing Committee on Government Operations found the absences of Senator Hoy excessive and recommended expulsion; now; therefore be it

 

RESOLVED,  that the North Carolina State University Student Senate hereby expels Senator Hoy on the charge of neglect of duty, as defined and authorized by §2-2.38. Expulsion for non-attendance of the Student Body Statutes; given the specifications:

 

1.       Senator Hoy missed the opening roll call for the Student Senate meeting on September 6, 2006;

2.      Senator Hoy missed the closing roll call for the Student Senate meeting on September 6, 2006;

3.      Senator Hoy missed the opening roll call for the Student Senate meeting on September 20, 2006;

4.      Senator Hoy missed the closing roll call for the Student Senate meeting on September 20, 2006;

5.      Senator Hoy missed the opening roll call for the Student Senate meeting on November 15, 2006;

6.      Senator Hoy missed the closing roll call for the Student Senate meeting on November 15, 2006;

7.      Senator Hoy missed the opening roll call for the Student Senate meeting on November 29, 2006;

8.      Senator Hoy missed the opening roll call for the Student Senate meeting on January 10, 2007;

9.      Senator Hoy missed the closing roll call for the Student Senate meeting on January 10, 2007;

10.  Senator Hoy missed the opening roll call for the Student Senate meeting on January 31, 2007;

11.  Senator Hoy missed the opening roll call for the Student Senate meeting on February 7, 2007;

12.  Senator Hoy missed roll call for the Public Affairs Committee meeting on September 13, 2006;

13.  Senator Hoy missed roll call for the Public Affairs Committee meeting on September 27, 2006;

14.  Senator Hoy missed roll call for the Academics Committee meeting on October 25, 2006;

15.  Senator Hoy missed roll call for the Academics Committee meeting on November 8, 2006;
