SENATE RESOLUTION 98

 

A RESOLUTION TO BE ENTITLED

AN ACT To Expel Senator Patel On The Charge Of Neglect of Duty Due to Excessive Absences

WHEREAS,   Mr. Patel, a student of North Carolina State University, was elected to Student Senate in April of 2006; and,

 

WHEREAS,   the Student Body Statutes, Chapter 2, Article 1, Rule 2f, provides that the Student Senate Standing Committee on Government Operations shall review the absences of a Student Senator should the Senator accumulate four (4) absences; and,

 

WHEREAS,   the Student Body Statutes, Chapter 2, Article 1, Rule 2e, provides that absences from formal meetings of Senate committees shall be treated as one-half (1/2) a Senate absence; and,

 

WHEREAS,   as of March 11, 2007 Senator Patel has missed a total of nineteen (19) Senate roll calls or committee meetings, totaling nine and half (9.5) total absences; and,

 

WHEREAS,   in a hearing conducted pursuant to rule on February 28, 2007, the Senate Standing Committee on Government Operations found the absences of Senator Patel excessive and recommended expulsion; now; therefore be it

 

RESOLVED,  that the North Carolina State University Student Senate hereby expels Senator Patel on the charge of neglect of duty, as defined and authorized by sections 38 and 9(a) of Chapter 2, Article 2 of the Student Body Statutes; given the specifications:

1.      Senator Patel missed the opening roll call for the Student Senate meeting on April 24, 2006;

2.      Senator Patel missed the opening roll call for the Student Senate meeting on September 6, 2006;

3.      Senator Patel missed the opening roll call for the Student Senate meeting on October 18, 2006;

4.      Senator Patel missed the opening roll call for the Student Senate meeting on October 22, 2006;

5.      Senator Patel missed the closing roll call for the Student Senate meeting on October 22, 2006;

6.      Senator Patel missed the opening roll call for the Student Senate meeting on January 10, 2007;

7.      Senator Patel missed the closing roll call for the Student Senate meeting on January 24, 2007;

8.      Senator Patel missed the opening roll call for the Student Senate meeting on January 31, 2007;

9.      Senator Patel missed the closing roll call for the Student Senate meeting on January 31, 2007;

10.  Senator Patel missed the opening roll call for the Student Senate meeting on February 21, 2007;

11.  Senator Patel missed the Committee on Appropriations meeting on October 25, 2006;

12.  Senator Patel missed the Committee on Appropriations meeting on February 20, 2007;

13.  Senator Patel missed the Committee on Appropriations meeting on February 26, 2007;

14.  Senator Patel missed Public Affairs Committee meeting on September 13, 2006;
