UNC Association of Student Governments Accountability Act

WHEREAS, current appointments to the UNC Association of Student Governments by NC State have little or no over-sight or system of being held accountable.
ENACTED, by the North Carolina State University Student Senate that:
Section 1. Statutory Authority. This bill is adopted pursuant to the provisions of Article II, Section 5(d) of the Student Body Constitution, and Chapter 2, Rule 17(b)(3) of the Student Body Statutes.
Section 2. Student Body Statutes §1-3 shall be amended by adding as follows:

§1-3.1. Oversight
Within this article the following definitions and conventions shall apply:
(a) “Association” refers to the University of North Carolina Association of Student Government.
( b ) “ Delegation” refers to an NCSU Student Government Delegation to the Association.
§1-3.2. Delegation Composition.
The Student Government delegation to the Association shall be headed by the Student Body President or an elected official he or she designates in his or her absence. The delegation shall be compromised of:
(a) the Student Body President, ex-officio;
(b) the Student Senate President, ex-officio;
(c) an existing Student Government Official appointed
by the Student Body President; and
(d) an existing Student Government Official appointed
by the Student Senate President.
§1-3.3. Confirmation of Appointed Delegates
All delegates appointed by the Student Body President or the Student Senate President must be approved by majority confirmation of the Senate before the first meeting of the Association of Student Government in the new academic year, such appointed delegates are hereby dual-office exempts. If the Senate is unable to take up the appointment due to being out of session for the summer then the appointing official may make a temporary appointment to the Association of Student Governments subject to termination at the first meeting of the Senate when the Academic Year begins.
§1-3.4. Alternates.
There may be four (4) alternate delegates appointed to attend the UNCASG meetings. The head of the delegations shall appoint two (2) alternates and the Student Senate President shall appoint two (2) alternates. Alternates must serve in a Student Government Office and must be confirmed by a majority vote of the Student Senate and are dual-office exempt.
§1-3.5. Removal of Delegates.
The Student Senate may, by Senate Resolution, remove any non-ex-officio delegate from the delegation. No such removed delegate may be reappointed unless such is allowed under the provisions of the Resolution.
§1-3.6. Delegation Report.
The delegation head shall prepare a detailed written report on the events of each association meeting, which shall be submitted to the Student Senate and the Presidential Cabinet within 5 class days of the close of the meeting.
§1-3.7. Accountability
Members of the North Carolina State University Delegation to the Association of Student Governments may be bound to behave as specified by a Special Resolution passed by a super-majority (2/3 majority). Any behavior by a delegate, that is deemed by the Public Affairs Committee to be in violation of a Resolution passed by the Senate will result in an automatic removal from the delegation by a simple majority vote of the committee. Any other potential disciplinary action deemed necessary by the Public Affairs Committee must be considered by the Senate as a whole.
§1-3.8. Oversight
Oversight of the department may be exercised by the Committee on Public Affairs, which shall have the power to review the records of the department, compel report of its members, and to make recommendations to the Delegates, Senate President, or Senate regarding its improvement.
Section 4. This act shall be effective upon its enrollment, and shall apply to all delegates appointed to the UNC Association of Student Governments during the 86th Session of the Student Senate.
