TO BE ENTITLED
AN ACT TO AUTHORIZE
THE ELECTIONS COMMISSION TO PERFORM A CANDIDATE SWITCH FOR THE SPRING 2008

WHEREAS, on March 13, 2008 President Pro Tempore Mike Alston, candidate for the office of Student Senate President, requested a withdrawal of his candidacy for stated personal concerns; and,
WHEREAS, the Elections Commission determined that under §7-1.24. Withdrawal from Candidacy. that Mr. Alston’s withdrawal from a joint campaign would “substantially impair a fair election” by placing Mr. Bobby Mills, candidate for the office of Student Body President, at a financial advantage over other SBP candidates by virtue of his joint campaign spending limit; and,
WHEREAS, the only way to remove Mr. Alston from candidacy while ensuring a fair and competitive election is to replace him with a Student Senate President candidate who would consequently be entered into a joint campaign with Mr. Mills; and,
WHEREAS, Article II Section 5(d) of the Student Body Constitution authorizes the Student Senate “to govern student election”; now, therefore, be it
RESOLVED, by the North Carolina State University Student Senate that the Elections Commission is hereby authorized to substitute Mr. Alston, who has expressed a lack of desire for candidacy, with Amber Joyner, who has since expressed an obvious desire for candidacy, in all respects of the election henceforth.
Section 1. This act shall be effective immediately upon its enrollment.
