A RESOLUTION TO BE ENTITLED

AN ACT TO FORMALLY CALL UPON CHANCELLOR OBLINGER TO APPOINT A COMMITTEE TO FORMULATE A CAMPUS WIDE HATE CRIME POLICY

WHEREAS,   on November 14 the NC State Student Senate passed the Racism and Hatred Incident Condemnation Act 48 to 0 by a roll call vote that called hate crime policies; and,

 

WHEREAS,   members of AASAC and the Student Body meet with Chancellor James Oblinger where interest was expressed that discussion needs to take place on a Hate Crime Policy; and,

 

WHEREAS,   Hate crimes (also known as bias motivated crimes) occur when a perpetrator targets a victim because of his or her membership in a certain social group, usually defined by race, religion, sexual orientation, disability, ethnicity, nationality, age, gender, gender identity, veteran status, or political affiliation, hate crimes differ from conventional crime because they are not directed simply at an individual, but are meant to cause fear and intimidation in an entire group or class of people; and,

 

WHEREAS,   current only case law applies when dealing hate crimes; and,

 

WHEREAS,   in the Supreme Court case Wisconsin v. Mitchell unanimously found that penalty-enhancement hate crime statutes do not conflict with free speech rights because they do not punish an individual for exercising freedom of expression; rather, they allow courts to consider motive when sentencing a criminal for conduct which is not protected by the First Amendment; and,

 

WHEREAS,   New York State and other states, countries around the world all have Hate Crime laws; and,

 

WHEREAS,   currently the state of North Carolina nor North Carolina State University have a policy or law that specifically deals with Hate Crimes; now, therefore, be it

 

RESOLVED,  by the North Carolina State University Student Senate that the Student Government and the Student Body call upon Chancellor James Oblinger to establish a Committee to develop a Hate Crime Policy dealing with all people on NC States Campus; and be it further,

 

RESOLVED,  NC State Student Government calls upon the Committee to be appointed prior to the Spring Semester and have a policy drafted by the end of the Spring Semester; and be it further,

 

RESOLVED,  NC State Student Government endorses the development of a Hate Crime Policy at North Carolina State University; and be it further,

 

RESOLVED,  NC State Student Government calls upon the Staff and Facility Senate to endorse and support this resolution as well as to adopt resolutions of there own; and be it further,

 

RESOLVED,  NC State Student Government encourages Chancellor James Oblinger to appoint the following Members to the Committee:

                                               

Co-Chair Chief Justice Lock Whiteside

Co-Chair Vice Provost for Equal Opportunity & Equity Joanne Woodard

A Staff Senate Representative

A Faculty Senate Representative

A Women’s Center Representative

A LGBT Center Representative

A Student Representative Appoint by Multicultural Student Affairs

Student Body President Robert Mills

One at Large Student Seat appointed by the Student Senate President
