WHEREAS, in recent years the Student Senate has had a
number of positions on the Spring general election ballot for which few or no
candidates file, enabling students to be elected with as few as five (5)
write-in votes; and,
WHEREAS, successfully elected write-in candidates are
frequently impeached for non-attendance and historically have provided little
meaningful representation of the Student Body; now, therefore be it
ENACTED, by
the North Carolina State University Student Senate that:
Section
1. Statutory Authority.
This bill is adopted pursuant to the provisions of Article II, Sections
5(d) and 5(e) of the Student Body Constitution, and Chapter 2, Rule 17(b)(3) of
the Student Body Statutes.
Section
2. Student Body Statutes §7-1.37 ("Write-In Winners") shall be
amended as follows:
§7-1.37. Write-in Winners.
In order to be
elected by write-in, a student must meet all qualifications for the office in
question. Additionally, the student must receive either fifty (50) votes or
votes from ten percent (10%) of those voting in the particular race, whichever
is less, to be eligible for election. All candidates must receive a minimum
of at least ten (5) write in votes. No
write-in candidate shall be included in a run-off election without express
consent of the candidate.
Section
3. This act shall be effective upon its
enrollment.
