A SENATE RESOLUTION TO BE ENTITLED
an act to VACATE SENATE SEATS RESERVED FOR unsworn senators-elect pursuant to statute §2-2.37
Short Title: Unsworn Senator-elect Removal Act (Senate)

WHEREAS, Jessica Chaplin and Petr Kasal, both students of North Carolina State University, were certified as Senators-elect by the Elections Board on or before April 11, 2007; and,
WHEREAS, Student Body Statutes §2-2.37 provides that the Student Senate may vacate a Senator-elect’s seat in the event that the Senator-elect has failed to take the oath of office after the occurrence of no less than two Senate meetings; and,
WHEREAS, as of April 27, 2007, these individuals have failed to take the oath of office; and,
WHEREAS, the Student Senate President, following the Senate's April 11, 2007 meeting, contacted each of these individuals to advise them the Senate seat to which they were elected would be vacated if they did not take the oath of office; and,
WHEREAS, to date, none of these individuals have contacted the Student Senate President or any other member of the Student Government regarding attendance at future Student Senate meetings or taking the oath of office at some other time; and,
WHEREAS, vacation of office does not preclude these individuals from serving in Student Government Office now or in any time in the future; now, therefore be it
RESOLVED, that the North Carolina State University Student Senate declares vacant the following Student Senate seats:
CALS senior and College of Design,
to which the respective Senators-elect were elected in March 2007.
