A RESOLUTION TO BE ENTILED AN ACT To Expel Senator Wall On The Charge Of Neglect of Duty Due to Excessive Absences

WHEREAS, Andrew Wall, a student of North Carolina State University, was elected as a Student Senator representing CHASS Seniors in the General Elections in April 2008; and,
WHEREAS, the Student Body Statutes, Chapter 2, Article 1, Rule 2f, provides that the Student Senate Standing Committee on Government Operations shall review the absences of a Student Senator should the Senator accumulate four (4) absences; and,
WHEREAS, the Student Body Statutes, Chapter 2, Article 1, Rule 2e, provides that absences from formal meetings of Senate committees shall be treated as one-half (1/2) a Senate absence; and,
WHEREAS, as of September 24, 2008, Senator Wall has missed a total of eight (8) Senate roll calls or committee meetings, totaling four (4) total absences; and,
WHEREAS, in a hearing conducted pursuant to rule on September 24, 2008, the Senate Standing Committee on Government Operations found the absences of Senator Wall excessive and recommended expulsion; now; therefore be it
RESOLVED, that the North Carolina State University Student Senate hereby expels Senator Wall on the charge of neglect of duty, as defined and authorized by sections 38 and 9(a) of Chapter 2, Article 2 of the Student Body Statutes; given the following specifications:
1. Senator Wall missed the opening roll call for the Student Senate meeting on August 27, 2008;
2. Senator Wall missed the closing roll call for the Student Senate meeting on August 27, 2008;
3. Senator Wall missed the opening roll call for the Student Senate meeting on September 10, 2008;
4. Senator Wall missed the closing roll call for the Student Senate meeting on September 10, 2008;
5. Senator Wall missed the roll call for the Government Operations Committee meeting on September 17, 2008;
6. Senator Wall missed the opening roll call for the Student Senate meeting on September 21, 2008;
7. Senator Wall missed the closing roll call for the Student Senate meeting on September 21, 2008;
8. Senator Wall missed the roll call for the Government Operations Committee meeting on September 24, 2008;
We hereby introduce the above resolution for reading in the NCSU Student Senate, pursuant to Student Body Statues ¤2-2.9(a) and on order of the Committee on Government Operations, this 25th day of September 2008.
