A RESOLUTION TO BE ENTILED AN ACT To Expel Senator Nelson On The Charge Of Neglect of Duty Due to Excessive Absences

WHEREAS, Dustin Nelson, a student of North Carolina State University, was elected as a

           Student Senator representing Engineering Juniors in the General Elections in the

           Spring General Elections in 2009; and,

 

WHEREAS,   the Student Body Statutes, Chapter 2, Article 1, Rule 2f, provides that the Student Senate Standing Committee on Government Operations shall review the absences of a Student Senator should the Senator accumulate four (4) absences; and,

WHEREAS,    the Student Body Statutes, Chapter 2, Article 1, Rule 2e, provides that absences from formal meetings of Senate committees shall be treated as one-half (1/2) a Senate absences; and,

 

WHEREAS,    as of November 1, 2009, Senator Nelson has missed a total of ten (10) Senate roll calls and eleven (11) Committee roll call meetings, totaling ten and one half (10 ½) total absences; and,

 

WHEREAS,    in a hearing conducted pursuant to rule on November 4th, 2009, the Senate Standing Committee on Government Operations found the absences of Senator Nelson excessive and recommended expulsion; now; therefore be it

 

RESOLVED,  that the North Carolina State University Student Senate hereby expels Senator Nelson on the charge of neglect of duty, as defined and authorized by sections 38 and 9(a) of Chapter 2, Article 2 of the Student Body Statutes; given the following

                        Specifications:

 

1.     Senator Nelson missed the opening roll call for the Student Senate meeting on

April 22, 2009;

 

2.     Senator Nelson missed the closing roll call for the Student Senate meeting on April 22, 2009;

3.     Senator Nelson missed the opening roll call for the Student Senate meeting on August 26, 2009;

 

4.     .     Senator Nelson missed the closing roll call for the Student Senate meeting on August 26, 2009;

 

5.     Senator Nelson missed the opening roll call for the Student Senate meeting on September 9, 2009;

 

6.     Senator Nelson missed the closing roll call for the Student Senate meeting on September 9, 2009;

 

7.     Senator Nelson missed the roll call for the Government Operations Committee meeting on September 16, 2009;

 

8.     Senator Nelson missed the opening roll call for the Student Senate meeting on September 23, 2009;

 

9.     Senator Nelson missed the closing roll call for the Student Senate meeting on September 23, 2009.

 

10.  Senator Nelson missed the roll call for the Committee on Appropriations meeting on September 24, 2009;

 

11.  Senator Nelson missed the roll call for the Committee on Appropriations meeting on September 25, 2009.

 

12.  Senator Nelson missed the roll call for the Committee on Appropriations meeting on September 27, 2009.
