TO BE ENTILED AN ACT To Expel Senator Clark On The Charge Of Neglect of Duty

WHEREAS, Philip Clark, a student of North Carolina State University, was elected as a Student
Senator representing College of Management in the General Elections in the Spring
General Elections in 2009; and,
WHEREAS, the Student Body Statutes,
Chapter 2, Article 1, Rule 2a, provides that the member
of the Student Body shall be considered a
qualified Senator-elect upon receipt by
the President of certification of his or her election to the
Senate from the Elections
Commission,
or a qualified Senator-designate upon the approval by a simple
majority of the Senate of his or her nomination by the President.; and,
WHEREAS, the Student Body
Statutes, Chapter 2, Article 1, Rule 2a, provides that Before such
a qualified Senator-elect or Senator-designate
may assume membership, he or she
shall be administered the oath of office by the President as required by statute; and
WHEREAS, as of November 4, 2009, Senator Clark has failed to comply with Student Body
Statutes stated in Chapter 2, Article 1, Rule 2a by omission of the oath of office by
the President; and,
WHEREAS, in a hearing conducted pursuant to rule on November 4th, 2009, the Senate
Standing Committee on Government Operations found the absence of oath of
office by Senator Clark in conjunction with excessive absences, the committee
recommends expulsion; now; therefore be it
RESOLVED, that the North Carolina State University Student Senate hereby expels Senator
Clark on the charge of neglect of duty, and failing to state the oath of office as
defined
and authorized by sections 38 and 9(a) of Chapter 2, Article 2 of the Student
Body Statutes;
We hereby introduce the above
resolution for reading in the NCSU Student Senate,
pursuant to Student Body Statues ¤2-2.9(a) and on order of the Committee on
Government Operations, this 11th day of November 2009.
