RESOLUTION 50

Senator Vinney Kalra submitted the following report regarding Resolution 50, "An Act Encouraging NCSU to Review Judicial Action Against Students for Actions That Occur Off University Property", on Monday, January 29, 2001, on behalf of the Campus Life Committee, and pursuent to its January 25, 2001 recommendations, with 5 members voting in the affirmative and in the negative:

As provided by Senate Rule 12(b), the committee requests that the Senate President place R 50 on the calendar for second reading.

Purpose of the Legislation:

To make the administration aware of our concern that the Student Code of Conduct extends the University's disciplinary jurisdiction past any reasonable bounds.

Debate:

The committee agreed that this issue should be supported.

Recommendations:

We recommend that the Senate consider the legislation.

Committee Amendments:

Change line 1 to say University's foremost purpose
Add and, at the end of line 2
Change line 4 to say in order to maintain
Add a comma in line 5 after University
Get rid of the last three words "the need to" on line 8
Get rid of the first word, "govern" on line 9
Add ;and, at the end of line 19 (?)
Insert a new clause in line 20 to read "WHEREAS, the Code of Student Conduct further comments that 'The University will not routinely invoke the disciplinary process for violations of this Code which occur off-campus' which allows the Code to be subjectively enforced; and,
Get rid of the and, in line 23 and replace with "now, therefore be it"
Get rid of the entire Whereas clause starting on line 25
