A BILL TO BE ENTITLED

An act to refine and supplement student body statutes concerning the Executive Branch and related entities

 

BE IT ENACTED, by the North Carolina State University Student Senate that:

Section 1. Student Body Statutes §1-1(a) shall be amended by adding: ", and not explicitly defined otherwise." So that the clause reads:

A "Student Government Official" is any student holding an elected or appointed position provided for by the Student Body Constitution or these Statutes, and not explicitly defined otherwise.

Section 2. Student Body Statutes §1-1(e) shall be amended by striking "the Wolf Aides Board of Advisors" so that the clause reads:

The term "public body" refers to student legislative bodies and committees thereof, Student Body Commissions, and the Elections Commission. 

Section 3. Student Body Statutes §1-2. Qualifications for Student Government Officials; dual office holding prohibited shall be struck, and the following inserted:

§1-2. General Qualifications for Student Government Officials.

All Student Government Officials shall be chosen from the Student Body at large, provided that they have not been prohibited from service following removal from office. The Student Body Auditor, as an exception, shall be chosen from any internal or external source as deemed appropriate by the Student Body President. All Student Government Officials must be students in good standing at the time of their appointment or election, and must remain such their entire term in office. Additional qualifications for specific offices may be assigned by these statutes.

§1-3. Dual Office Prohibition.

No Student Government Official may serve in more than one Student Government Office at any one time, unless such additional offices are considered Dual Office-holding Exempt (SBS §1-4).

§1-4. Dual Office-holding Exemption.

A position shall be considered dual-office holding exempt if so specified by these statutes. Furthermore, the Senate shall be empowered to grant, by Senate Resolution, a temporary dual-office holding exemption for any particular office and candidate. Such resolution must be adopted by a two thirds vote following a recommendation by the official seeking to make the appointment. At no time shall a temporary exemption be granted to an official serving in an elective office or for the purpose to serve in an elective office.

Section 4. Student Body Statutes §1-4 shall be amended by adding: "(e) Student Government Officials empowered with appointing authority shall administer the oath to each of their appointees"

Section 5. The Chapter 1 Student Body Statutes shall be amended by inserting after §1-4. Oath of Office; administration of oath:

§1-7. Common Staffs Generally.

Common staffs shall exist for the purpose of aiding the official or deliberative body served in executing its duties, especially those relating to administration. No Common Staff shall exist beyond the dissolution or vacation of the body or office served.

§1-8. Common Staff Eligibility.

    1. All Student Senate Committees and Student Body Commissions shall be entitled to retain common staffs.
    2. Any Student Government Official serving in an elective office or an appointed office explicitly defined in statute, but not existing within another common staff, shall be eligible to retain a common staff.

§1-9. Common Staff Composition.

    1. Common staffs may be comprised of both Student Government Officials and non-officials, with such title as appropriate for the staff served. All staff members must be duly enrolled students.
    2. If a common staff serves a dual office-holding exempt official, the officials within the staff shall also be considered dual office-holding exempt.
    3. At no point shall an individual student serve as staff to an official who sits on a public body as a peer to the individual, nor shall an individual serve as staff to a body that reports directly or indirectly to a body the individual is a member of.
    4. All common staffs with greater than eight (8) members shall be coordinated by a Chief of Staff, who shall be considered a Student Government Official. The staff holder may co-designate other staff members as Deputy Chiefs of Staff to signify rank and authority.
    5. Section 6. Student Body Statutes §1-5 shall be amended by striking "(d) To consider the appointment of an individual to a non-public body. (e) To plan, conduct, or hear reports concerning investigations of malfeasance;" and inserting "(d) To consider the appointment or removal of an individual to or from a non-public body".

      Section 6A. Student Body Statutes §2-1.10(g) shall be amended by striking "the implementation of Nightwalk"

      Section 7. Student Body Statutes §3-1.1 shall be amended by inserting: "(g) "Agency" refers a distinct division of Student Government empowered with independence greater than that of a Department."

      Section 8. Student Body Statutes §3-1.2. Staff Appointments. shall be struck.

      Section 9. Student Body Statutes §3-1.3. Public Appointments. shall be struck and the following inserted:

      §3-1.2. Public Appointments.

      All appointments by Student Government Officials requiring confirmation of the Senate, with the exception of the Executive Chief of Staff, the Executive Assistant to the President, members of the Judicial Affairs Office, and the officers of Select Commissions, shall be termed "Public Appointments." The appointing official must make a public announcement and accept applications prior to making any given public appointment.

      §3-1.3. Spring Public Appointments.

      The Executive Counsel, in cooperation with the President, shall prepared and release application materials for all cabinet-level public appointments to be made by the incoming Student Body President no latter than the last Friday of March. The newly elected President shall retain discretion to modify the application.

      Section 10. Student Body Statutes §3-1.5 shall be amended by striking "without" and inserting "not requiring" so that the clause reads:

      (a) All appointments made not requiring approval of the Senate shall take effect immediately.

      Section 11. Student Body Statutes §3-1.6 shall be amended by inserting "or other appointing official" so that the clause reads:

      Unless a specific deadline is provided for the appointment to an office provided for within this chapter, the President or other appointing official shall have the discretion to leave it indefinitely vacant.

      Section 12. Student Body Statutes §3-1.10(e) shall be amended by striking "on option of the President" and inserting "in residence to the Executive Branch itself and not otherwise excluded" so that the clause reads:

    6. Heads of Standing Student Body Commissions, in residence to the Executive Branch itself and not otherwise excluded

Section 13. Student Body Statutes §3-1.10. Presidential Cabinet Members. shall be amended by adding "(i) the Executive Counsel".

Section 14. Article 1 of the Chapter 3 Student Body Statutes shall be amended by inserting after §3-1.10. Presidential Cabinet Members.:

Part III. Officers

§3-1.11. Student Body President.

The chief executive authority of the Student Body shall rest with the Student Body President, as duly elected by the Student Body. In addition to such duties assigned in the Constitution, the President shall:

    1. Ensure the faithful execution of all acts of the Senate, of these statutes, and of the constitution;
    2. Facilitate the transmittal of information and concerns to Committees, Commissions, and Departments;
    3. Recommend students for appointment to university committees and boards in all cases;
    4. Coordinate the work of all Departments, Agencies, and Commissions;
    5. Promote all opportunities for greater student self-governance;
    6. Encourage the Senate, through its Standing Committees, to investigate issues of student concern;
    7. Coordinate the selection of delegates for any conferences Student Government may from time-to-time attend.

§3-1.12. Qualifications for Student Body President

There should be no qualifications for Student Body President beyond the general qualifications for office.

§3-1.13. Student Senate President.

The Student Senate President, as duly elected by the Student Body, shall be considered the executive vice president of the Student Body. In addition to such duties concerning the administration of the Senate and those assigned in the Constitution, the Senate President shall:

    1. Serve as vice-chair of all bodies the President serves ex-officio as chair of;
    2. Aide the President in the coordination of the Executive Branch;
    3. Attend meetings of university panels of which the President is a member in cases which the President cannot attend.

§3-1.14. Qualifications for Student Senate President.

No student shall serve as Student Senate President who has not served as a member of the Senate through at leas the majority of the meetings of any given session of the Senate.

Section 14. Student Body Statutes §3-1.12 shall be amended by striking "The President shall submit, in writing, his or her reasons for the veto to the Student Senate President. (SBS §2-1.18)" and inserting "For a veto to be valid, the President must submit a written explanation of the reasons for the veto to the Senate President within one (1) calendar day of the date of veto."

Section 15. Article 1 of the Chapter 3 Student Body Statutes shall be amended by adding:

Part V. General Provisions

§3-1.15. General Oversight.

Recognizing that appointed bodies bear the inherent risk of becoming distanced from the electorate, it shall be the policy of this government to fully comply with the scrutiny of the elected Student Senate. Additional specific oversight responsibilities may be assigned by statute, order, or precedent.

Section 16. Article 2 of the Chapter 3 Student Body Statutes shall be amended by inserting after §3-3.2. Types of Commissions.:

§3-2.3. Promotion to Standing.

When chartering a Standing Commission that replaces either a Special or Select Commission, the Senate shall be empowered to waive the appointments process for the new commission and retain the officers and/or membership in entirety. Such a commission shall be deemed "promoted".

§3-2.4. Dissolution of Special Commissions.

The President shall be empowered to dissolve any Special Commission by executive order. The Student Senate Committee on Government Operations shall be notified of all dissolutions no less than ten (10) regular semester class days prior to the effective date of dissolution. Dissolved Special Commissions may be promoted to Standing up to twenty (20) class days after dissolution.

§3-2.5. Commission Residence.

Each Student Body Commission shall be in residence of either the Executive Branch itself, the Office of the Student Body President, or a single department, division, or agency. Commissions not in residence to the Executive Branch shall report to the Cabinet through such entity that they reside within.

Section 17. Student Body Statutes §3-2.3. Commission Charter. shall be amended by adding: "(i) residence of the commission (SBS §3-2.5)."

Section 18. Student Body Statutes §3-3.2 shall be amended by inserting "and shall be considered the President’s common staff §SBS §1-7)" so that the first sentence reads:

The Executive Staff is comprised of students working directly under the supervision of the Student Body President to the effect of aiding him or her with the particular responsibilities of that office, and shall be considered the President’s common staff (SBS §1-7).

Section 19. Article 3 of the Chapter 3 Student Body Statutes shall be amended by inserting after §3-3.4. Executive Assistant to the President.:

§3-3.5. Executive Counsel.

The President shall appoint, with the majority confirmation of the Senate, an Executive Counsel, who shall be considered a Student Government Official. The Executive Counsel shall be responsible for advising the President and other Executive Branch Officials on their obligations under the Student Body Statutes. The Counsel shall assist the President with investigating applicants for appointment, designing public appointment materials, and preparing Executive Orders. The Counsel shall liaise with the Senate Standing Committee on Government Operations and together with that body oversee any legal affairs that Student Government may become involved in.

Section 20. Student Body Statutes §3-3.5 shall be amended by adding "and (iv) Director" so that the final sentence reads:

No title shall be awarded to a member of the Executive Staff that would serve to cause confusion as to the official’s place in the structure of Student Government, including, but not limited to: (i) Vice President, (ii) Secretary, (iii) Minister, and (iv) Director.

Section 21. Student Body Statutes §3-5.6 shall be amended by inserting "the Sunday prior to" so that the first sentence reads:

The President shall appoint a Director of Government Relations no later than the Sunday prior to the last Senate meeting after his election prior to the conclusion of the spring semester, subject to the majority confirmation of the Senate.

Section 22. Article 6 of the Chapter 3 Student Body Statutes shall be amended by inserting after §3-6.6. Active Policy Journal.:

§3-6.7. Executive Order Appendix.

The Division shall maintain, as an appendix to the Active Policy Journal, a detailed record of all Executive Orders not expired or repealed in law of effect.

Section 23. Student Body Statutes §3-6.7 shall be amended by inserting "the Sunday prior to" so that the first sentence reads:

The President shall appoint a Director of Implementation no later than the Sunday prior to the final Senate meeting of the spring semester, subject to the majority confirmation of the Senate.

 

Section 24. Article 7 of the Chapter 3 Student Body Statutes shall be substituted as follows:

Article 7. Department of Community Service.

§3-7.1. Definitions and Conventions.

Within this article, the following definitions and conventions shall apply:

  1. The "Department" refers to the Department of Community Service.
  2. "Director" refers to the Director of Community Service.
  3. "Associate Director" refers to an Associate Director of Community Service.

§3-7.2. Name.

The name of this organization shall be the North Carolina State University Student Body Department of Community Service, and may be simply referred to as the Department of Community Service.

Part I. Powers and Duties.

§3-7.3. Purpose.

The Department of Community Service shall work to enhance Student Body involvement in Community Service and to provide effective governance of all service projects organized by Student Government.

§3-7.4. Duties.

The Department shall:

  1. assist all Student Government entities with the planning and execution of such community service projects they may choose to undertake;
  2. provide resources, advice, and assistance to Registered Student Organizations involved in community service;
  3. foster cooperation and cross-promotion between the various campus organizations engaged in community service;
  4. maintain a centralized database of service events and organizations;
  5. advise the Department of the Treasury and the Senate Finance Committee on the soundness of all community service related financial requests; and
  6. plan and execute the Standing Service Projects.

Part II. Director and Officials.

§3-7.5. Director of Community Service.

The Director of Community Service shall be considered a Student Government Official, and shall have executive authority over the department, and shall specifically:

  1. Serve as the Student Body President’s principle advisor on matters relating to community service;
  2. Coordinate the activities of the other officials, the staff, and the commissions of the department;
  3. Report on the activities of the department to the Student Senate;
  4. Provide direction and goals for the efforts of the department.

§3-7.6. Selection of Director.

The President shall appoint a Director of Community Service no later than the Sunday prior to the last Senate meeting after his election prior to the conclusion of the spring semester, subject to the majority confirmation of the Senate. There shall be no qualifications for Director beyond those of a Student Government Official.

§3-7.7. Associate Directors of Community Service.

Each of the several standing service projects shall be headed by an Associate Director of Community Service, who shall be considered a Student Government Official. In addition to such duties related to the administration of his or her respective project, each Associate Director shall assist the Director in completing the duties of the department, especially those involving projects similar to the respective standing project.

§3-7.8. Appointment of Associate Directors.

The President shall appoint the Associate Directors of Community Service no later than the fifth class day of the fall semester, subject to the majority confirmation of the Senate.

§3-7.9. Assistant Directors.

Without confirmation of the Senate, the President may appoint any number of Assistant Directors of Community Service, who shall be considered Student Government Officials. Assistant Directors shall report to the Director and shall have specific permanent duties as designated by the President.

§3-7.10. Department Staff.

The Director shall appoint whatever staff he or she deems necessary for the operation of the department without the confirmation of the Senate. Such individuals must be properly enrolled students, but shall not be considered Student Government Officials.

§3-7.11. Terms of Office.

The term of the Director and Associate Directors of Community Service shall end upon the appointment of their respective successors. Assistant Directors and Department Staff shall serve at the discretion of the President and Director respectively.

Part III. Standing Service Projects.

§3-7.12. Standing Service Projects.

The Service Projects chartered within this chapter are so chartered with recognition that they offer a real continued benefit to both the Student Body and the community of which it is a part. All standing service projects shall have an allocation included in the Student Body Budget.

§3-7.13. Service Raleigh.

Service Raleigh shall be an annual event designed to foster in its participants both a lasting dedication to serve and a consistent commitment to the community.

§3-7.14. Service Raleigh Administration.

Service Raleigh shall be jointly administered by the Department and the Park Scholarships Program. The Associate Director for Service Raleigh shall serve as Student Government Project Co-chair.

§3-7.15. Service Raleigh Operations.

The Student Government and Park Scholars Project Chairs shall jointly determine the staff structure for the project. No member of such staff shall be considered a Student Government Official. The Project Chairs shall provide a regular report through the Department to the Presidential Cabinet regarding the status of the project.

§3-7.16. Feed Raleigh.

Feed Raleigh shall be an annual food drive competition amongst Student Organizations, administered by the Feed Raleigh Commission.

§3-7.17. Feed Raleigh Commission.

The Student Body Commission on Feed Raleigh shall be a Student Body Commission, in residence to the Department, and shall be charged with the planning and execution of the Feed Raleigh Competition. The Commission shall announce the proposed timetable for the competition no later than the last day of September.

§3-7.18. Feed Raleigh Commission Membership.
The Feed Raleigh Commission shall have at least three (3) members, including the Associate Director for Feed Raleigh, who shall serve as chair.

§3-7.19. Recreate State.

Recreate State shall be a periodic service project with the design to physically beautify the campus.

§3-7.20. Recreate State Commission.

The Student Body Commission on Recreate State shall be a Student Body Commission, in residence to the Department, and shall be charged with the planning and execution of the Recreate State projects. The Commission shall announce the academic year’s project schedule no later than the last day of September.

§3-7.21. Recreate State Commission Membership.
The Recreate State Commission shall have at least three (3) members, including the Associate Director for Recreate State, who shall serve as chair.

Part IV. General Provisions.

§3-7.22. Over-budget Projects.

In the event a service project under the auspices of the Department exceeds its available budget, the Senate Committee on Finance shall review the situation and shall recommend that the deficit be covered by either: (i) discretionary allocations of the Treasurer, (ii) appropriation by Senate action, or (iii) personal restitution by the official overspending.

§3-7.23. Oversight.

Oversight of the department may be exercised by the Committee on Campus Community, which shall have the power to review the records of the department, compel report of its members, and to make recommendations to the Director, President, or Senate regarding its improvement.

§3-7.22. Nightwalk.

Nightwalk shall be a semiannual early evening safety walk or re-walk through the various parts of the university campus.

§3-7.23. Nightwalk Commission.

The Student Body Commission on Nightwalk shall be a Student Body Commission, in residence to the Department, and shall be charged with the planning and execution of the Nightwalk program.

§3-7.24. Nightwalk Commission Membership.

The Nightwalk Commission shall be chaired by the Associate Director for Nightwalk, and shall have the following members:

  1. Between two (2) and four (4) at-large students;
  2. Two (2) members of the Senate University Affairs Committee, appointed by the President;
  3. The Associate Director of Community Service for Nightwalk.

Section 25. Student Body Statutes §3-8.6 shall be amended by inserting "There shall be no deadline for the appointment of the Webmaster" so that the section reads:

The President shall, with the majority confirmation of the Senate, appoint a Student Government Webmaster, who shall be considered a Student Government Official. There shall be no deadline for the appointment of the Webmaster. The Webmaster shall have the responsibility for the overall execution of the responsibilities of the Division of Web Development.

Section 26. Student Body Statutes §3-8.10 shall be amended by inserting "in residence to the Division" so that the first sentence reads:

The Commission on Web Development shall be considered a Student Body Commission, in residence to the Division, and shall be responsible for:

Section 27. Student Body Statutes §3-8.13 shall be amended by striking "with the request, he or she" and inserting "the request, he or she shall".

Section 28. Student Body Statutes §3-9.2 shall be amended by adding "in residence to the Executive Branch".

Section 29. Student Body Statutes §5-1.5 shall be amended by striking "Student Body Comptroller" from the title and "shall be appointed by the Treasurer and the President prior to the beginning of the fiscal year, and" so that the preamble of the clause reads:

§5-1.5. Administration of Budget.

The Comptroller shall administer the annual budget as approved by the Senate, subject to the following provisions:

Section 30. Student Body Statutes §5-1.6 shall be amended by striking the two instances of "Office of the Treasurer" and inserting "Department of the Treasury".

Section 31. Student Body Statutes §5-1.9(a) shall be amended by striking "Office of the Treasurer" and inserting "Inspector General".

Section 32. Student Body Statutes §5-1.10 shall be amended by inserting "The Senate shall be empowered to, by Senate Resolution, determine the need for an Auditor and set a deadline for such appointment by the President." So that the section reads:

§5-1.10. Student Body Auditor.

An Auditor may be appointed by the Student Body President, subject to the simple majority confirmation of the Senate, if it is believed that improprieties in the handling of the Student Body Funds exist. The Senate shall be empowered to, by Senate Resolution, determine the need for an Auditor and set a deadline for such appointment by the President. All accounting records must be made available to the Auditor at his or her request.

Section 33. Chapter 5 of the Student Body Statutes shall be amending by adding:

Article 3. Department of the Treasury

§5-3.1. Definitions and Conventions.

Within this article, the following definitions and conventions shall apply:

  1. The "Department" refers to the Department of the Treasury.
  2. "President" refers to the Student Body President.
  3. The "Budget" refers to the Student Government Budget of Student Body Funds.
  4. "Fee" refers a student fee collected by the University.
  5. "Fee supported program" includes all University bodies directly funded by fees and all programs funded by appropriations from the Student Government, the College Councils, the Student Media Authority, and the Union and University Student Centers and subordinate bodies.

§5-3.2. Name.

The name of this organization shall be the North Carolina State University Student Body Department of the Treasury and may be simply referred to as the Department of the Treasury.

Part I. Powers and Duties.

§5-3.3. Purpose.

The Department of the Treasury shall ensure sound fiscal policies and planning for all Student Government Bodies and Officials and promote the same for all external bodies supported by fee receipts.

§5-3.4. Principle Duties.

The Department shall:

  1. support and enforce proper financial practices by all units of Student Governance under the Student Body and Union Constitutions;
  2. provide for the faithful execution of the Budget and all Appropriations, Finance, and Program Bills;
  3. monitor all expenditures of funds out of the Budget by external organizations;
  4. account for all allocations and expenditures from the Budget;
  5. advise the Senate Finance Committee on all such matters it deems necessary;
  6. prepare the initial draft of an annual Student Body Budget in support of the Finance Committee’s SBS §5-1.3 budget recommendation;
  7. coordinate use of the Student Government Office and other facilities, consistent with statute.

Part II. Treasury Officials.

§5-3.5. Student Body Treasurer.

The executive authority over the Department of the Treasury shall rest with the Student Body Treasurer, as duly elected by the Student Body. In addition to such duties assigned in the Constitution, the Treasurer shall:

  1. Serve as the principle advisor to the heads of each branch, department, and agency on the finances of said body;
  2. Coordinate the activities of the other officials and staff of the department;
  3. Report on both departmental activities and Student Governmental fiscal status to the Student Senate and the Presidential Cabinet;
  4. Provide impartial assistance to Student Senators drafting bills appropriating or allocating student body funds;
  5. Award contracts for services, as permitted by statute;
  6. Appoint officials and assistants into the department as provided by statute.

§5-3.6. Student Body Comptroller.

The Student Body Comptroller shall be considered a Student Body Officer and the senior appointed official of the Department. In addition to such duties assigned in the Constitution, the Comptroller shall:

  1. Advise the Treasurer on all matters concerning accounting, banking, and transmittal of funds;
  2. Provide semiannually a comprehensive written report to the Senate on the status of all accounts and budgets of Student Government and its subsidiaries;
  3. Oversee all financial record keeping, including the management of receipts.

§5.3.7. Appointment of the Comptroller.

The Treasurer shall appoint, with the concurrence of the President, a Student Body Comptroller prior to the beginning of the fiscal year, subject to the majority confirmation of the Senate. In the event the Senate does not take up consideration of such confirmation within twelve business days, the appointee shall receive the full powers and duties of the office until such time the Senate begins said confirmation consideration. The Comptroller shall have passed ACC 210 or ACC 280 with a grade of C or better by the effective date of appointment.

§5-3.8. Student Body Inspector General.

The Student Body Inspector General shall be considered a Student Government Official, and shall:

  1. Advise the Treasurer and the President on matters of external fee expenditures;
  2. Review the financial records of external fee supported programs, as provided by these statutes;
  3. Promote and encourage transparency in the use of fee moneys;
  4. Report on the activities of the office to the Senate Committee on Tuition and Fees;
  5. Maintain accessible means for members of the Student Body to report concerns involving use of fee moneys;
  6. Support and assist the Senate Committee on Tuition and Fees on matters of fee review.

§5-3.9. Appointment of Inspector General.

The Treasurer shall appoint an Inspector General no later than the fifth class day of the fall semester, subject to the majority confirmation of the Senate. There shall be no qualifications for Inspector General beyond those of a Student Government Official.

§5-3.10. Assistant Treasurers.

Without confirmation of the Senate, the Treasurer may appoint any number of Assistant Student Body Treasurers, who shall be considered Student Government Officials. Assistant Treasurers shall have specific permanent duties as designated by the Treasurer.

§5-3.11. Staffs.

As per SBS §1-2, explicit statutory officials of the department shall be permitted to retain staffs of officials and assistants to aid them in executing the duties of their individual offices. Staff of the Treasurer shall be distinguished from Assistant Treasurers by less involvement in the powers and duties of the department and more involvement in the powers and duties of the office of Treasurer itself.

Part III. External Fee Inspection.

§5-3.12. External Fee Inspection.

The processes of external fee inspection shall be conducted by the Inspector General with such direction provided by the Treasurer and the President.

§5-3.13. Program Review.

Upon instruction from either the Senate, the President, or the Treasurer; or on his or her own accord, the Inspector General shall thoroughly review the finances of any fee supported program. When such review is complete, the Inspector General shall publish a public report detailing the manner and method of the program’s expenses.

§5-3.14. Complainant Investigation.

When concerns or complainants involving the use of fee moneys are received by the Inspector General, he or she shall investigate the nature of the expenditure. The Inspector General shall report to the Senate Committee on Tuition and Fees any matters that seem inconsistent with the policies or best interests of the Student Body.

§5-3.15. Financial Improprieties.

Should in the course of investigations or reviews the Inspector General encounter activities that amount to financial improprieties, the Inspector General shall report those activities to the University Auditor, in the case of employee run programs, or the Office of Student Conduct and the Senate Committee on Campus Community, in the case of student run programs.

§5-3.16. External Limit.

External Fee Inspection powers shall not extend to use of Student Body Funds by bodies of the Student Government; internal audit authority shall remain vested with the Student Body Auditor (SBS §5-1.X). The Inspector General shall forward all complains concerning such internal fee use to the Auditor, if appointed, otherwise to the President, the Senate Committee on Finance, and the Senate Committee on Government Operations.

Part IV. Limits.

§5-3.17. Oversight.

Oversight power, which shall include the power to review the records of the department, compel report of its members, and to make recommendations to the Treasurer, President, or Senate regarding its improvement, shall rest with the Committee on Tuition and Fees, on matters related to the Office of Inspector General; the Committee on Finance, on matters related to the Office of Comptroller; and the Committee on Government Operations, on matters related to the Office of Treasurer or the department in general.

Section 34. Chapter 8 Student Body Statutes shall be substituted as follows:

CHAPTER 8.

The Wolf Aides Program.

§8-1. Definitions and conventions.

Within this chapter, the following definitions and conventions shall apply:

  1. "Wolf Aide" refers to a freshman member of the Wolf Aides.
  2. "Director" refers to the Director of the Wolf Aides Program.
  3. "Directors" refers collectively to the Director and all Associate and Assistant Director of the Wolf Aides Program.
  4. "Commission" refers to the Wolf Aides Commission.
  5. The "agency" refers to the Wolf Aides Program, a Student Government Agency.

§8-2. Name.

The name of this organization shall be The North Carolina State University Student Government Wolf Aides Program, and may be referred to as simply the Wolf Aides Program.

§8-3. Affiliation.

The Wolf Aides Program shall be considered an Agency of the North Carolina State University Student Government, as defined by SBS §3-1.1, and shall be regulated through these statutes and their bylaws.

§8-4. Objective.

The objective of the Wolf Aides program is to produce and sustain an effective community of student leaders at North Carolina State University.

§8-5. Focus.

The Wolf Aides Program shall provide content relating to Leadership Development, the University’s administration, the rest of Student Government, and other student leadership opportunities on campus.

Part I. Membership

§8-6. Membership Eligibility.

Membership in the Wolf Aides Program shall only be extended to first year students in good standing with the University.

§8-7. Membership Selection.

The Commission shall establish a comprehensive membership selection procedure in the Wolf Aides By-Laws. At minimum the membership selection procedure shall include an interview process.

Part II. Directors

§8-8. Wolf Aide Director.

The Wolf Aides Director shall be considered a Student Government Official, and shall have executive authority over the agency, and shall specifically:

  1. Execute all meetings of the Wolf Aides, the Wolf Aides Directors, and the Wolf Aides Commission;
  2. Report in writing monthly on the operations of the program to Student Senate;
  3. Report on the affairs of the agency to the Cabinet;
  4. Advise the Student Body President on the status on the program;
  5. Coordinate the activities of the associate and assistant directors;
  6. Oversee the interview and application process.

§8-9. Selection of Director.

The Student Body President shall appoint a Director no later than first Sunday of March, subject to the majority confirmation of the Senate. There shall be no qualifications for Director beyond those of a Student Government Official.

§8-10. Associate Directors.

Director may appoint any number of Wolf Aides Associate Directors, subject to the majority confirmation of the Commission, who shall be considered Student Government Officials. The position shall be exempt from the dual office-holding ban of SBS §1-2, but no Associate Director may hold a second Student Government Office within the Wolf Aides Program. Associate Directors shall report to the Director and shall have specific permanent duties as designated by the Director. The Director shall designate one Associate Director as Senior Associate Director, who shall discharge the duties of the Director in his or her absence.

§8-11. Assistant Directors.

The Director may appoint any number of Assistant Directors who shall not be considered Student Government Officials. Assistant Directors shall be distinguished from Associate Directors by irregular involvement, less responsibility, and/or less discretion.

§8-12. Wolf Aides Webmaster.

The Wolf Aides Director shall designate one of the Directors Wolf Aide Webmaster, who shall maintain a website for the agency on space provided by the Division of Web Development. The Wolf Aides Webmaster shall comply with all regulations of and concerning the Division of Web Development.

§8.13. Terms of Office.

The term of the Wolf Aides Director shall end upon the appointment and confirmation of his or her successor. Associate and Assistant Directors shall serve at the discretion of the Director. Non-director members of the Commission shall serve terms as provided by SBS §3-2.

Part III. Wolf Aides Commission.

§8-14. Wolf Aides Commission.

The Wolf Aides Commission shall be considered a Student Body Commission, in residence to the Agency, and shall have the following reserved powers:

  1. to enact and amend the Wolf Aides Budget;
  2. to enter into contracts, consistent with Student Government financial regulations;
  3. to suspend or remove Wolf Aides, Assistant Directors, and Associate Director, per §8-14;
  4. to review and approve or disapprove all major changes to the program, as proposed by the Director; and
  5. to enact and amend the Wolf Aides Bylaws per §8-17.

§8-15. Commission Composition.

The Wolf Aides Commission shall be chair by the Wolf Aides Director, and shall be comprised of the following individuals:

  1. The Wolf Aides Director;
  2. The Senior Associate Wolf Aides Director;
  3. Two (2) Associate Wolf Aides Directors, selected by the Student Body President;
  4. One (1) representative from each of the Student Senate, Executive Branch, and Judicial Boards, selected by the Student Body President; and
  5. The Student Body Treasurer or his or her designate.

§8-16. Limit for non-Directors.

The Commission members holding non-Wolf Aides Director seats shall take no day-to-day role in the operation or conduct of the program, and shall be barred from holding any other position within the agency. Such members shall retain a responsibility to protect the best interests of the Program.

Part IV. Disciplinary Procedures.

§8-17. Removal of Directors.

The Director and all Associate Directors are considered Student Government Officials, and as such are subject to the punitive powers of the Senate per §2-2. The Commission may remove any Associate or Assistant Director by a three-fourths (3/4) vote of the Board.

§8-18. Removal of Wolf Aides.

The Commission may remove a Wolf Aide from the program with documented due cause, including excessive absences, as outlined in the Wolf Aides Bylaws. The Commission shall remove no Wolf Aide by less than a three-fourths (3/4) vote. Should a Wolf Aide be removed from a Student Government office by action of the Senate, they are to be automatically dismissed from the Wolf Aides Program.

Part V. Miscellaneous.

§8-19. Wolf Aides holding office.

  1. The position of Wolf Aide shall not be considered a Student Government Office.
  2. The Wolf Aides Program shall encourage Wolf Aides to seek and hold other positions within Student Government.
  3. The Wolf Aides Directors and Commission shall take no action to discourage any Wolf Aide from becoming actively involved in Student Government during their tenure as a Wolf Aide.

§8-20. Amendments to The Wolf Aides Bylaws.

The Wolf Aides Bylaws shall be the by-laws of this chapter of The Student Body Statutes, and shall be enacted or amended by a two-thirds (2/3) vote of the members of the Commission, provided that the details of the proposed amendment have been announced to the commission members seven (7) calendar days prior to the meeting at which it is to be considered.

§8-21. Oversight.

Oversight of the agency may be exercised by the Committee on Government Operations, which shall have the power to review the records of the agency, compel report of its members, and to make recommendations to the Director, President, or Senate regarding its improvement.

Section 35. All appointees to chairmanship or standing service commissions during the 2002-2003 session previously confirmed shall stand reconfirmed upon their appointment to the respective replacement offices.

Section 36. This act shall take effect upon enrollment.
