A BILL TO BE ENTITLED

An act to Revise Structural Provisions of the Executive Branch to Ensure Proper Management of Executve Resources

 


BE IT ENACTED,     by the North Carolina State University Student Senate that:

 

Section 1.        Chapter 1, Article 2 of the Student Body Statutes shall be amended by striking:

 

§1-2.3. Delegation Composition.

(a)     The Student Government Delegation to the Association shall be comprised of the Student Body President and Student Senate President, ex-officio, and additional at-large delegates appointed by the Student Body President up to the maximum allowable by the rules of the Association, subject to the simple majority confirmation of the Senate. All delegates must serve as Student Government Officials.

(b)     The Delegation shall be headed by the Student Body President, ex-officio. In the event that president cannot attend a given meeting, the Student Senate President shall head the delegation. At no time shall a non-elected official head the delegation.

 

§1-2.4. Alternates.

Whenever possible, Student Government shall be represented at the Association with the maximum allowable number of delegates. The Student Body President may designate an alternate to a delegate up to 24 hours prior to the meeting. The acting head of the delegation may designate an alternate to a delegate within 24 hours of a meeting. All alternates must serve in elective or statutory Student Government Offices, excluding positions on common staffs.

§1-2.3. Delegation Composition.

(a)     The Student Government Delegation to the Association shall be comprised of (i) the Student Body President, ex-officio, (ii) the Student Senate President, ex-officio, and (iii) additional at-large delegates up to the maximum allowable by the rules of the Association, appointed by the President. Such at-large delegates must hold Student Government Offices, and shall be subject to the simple majority confirmation of the Senate unless already holding an elected or confirmed position.

(b)     The Student Body President shall head the delegation. In the event that the president cannot attend a given meeting, another elected official shall be designated head by the president.

 

§1-2.4. Alternates.

The head of the delegation may designate an alternate delegate for any given meeting, in the event the permanent delegate is unable to attend. Alternates must serve in a Student Government Office.

 

 

Section 2.        Student Body Statutes §3-1.3. Spring Public Appointments. shall be amended by striking “Executive Counsel” and inserting “Director of Executive Management”.

 

Section 3.        Student Body Statutes §3-1.11 shall be inserted as follows:

 

§3-1.11. Terms of Appointment.

In all cases in which an appointee has a term lasting to the appointment of his or her successor, the term shall extend beyond the presidential term (Senate session) of service only on an interim basis, and not for more than five (5) calendar months.

 

 

Section 4.        Chapter 3, Article 6 of the Student Body Statutes shall be struck, and inserted as follows:

 

Article 6. Implementation Division

 

§3-6.1. Definitions and conventions.

Within this article, the following definitions and conventions shall apply:

(a)      The “Division” refers to the Implementation Division.

(b)     “Director” refers to the Director of Implementation.

(c)      “Policy Resolution” refers to any resolution of the Student Senate that affects external Student Body Policy.

 

§3-6.2. Name and Affliation.

The name of this organization shall be the North Carolina State University Student Government Implementation Division, and may be simply referred to the Implementation Division. The Division shall be considered a Student Body Department.

 

Part I. Powers and Duties.

 

§3-6.3. Purpose.

The Implementation Division shall cause collaborative and thorough action to support and encourage the implementation of the policies of the Student Body.

 

§3-6.4. Implementation Planning.

(a)      The Implementation Division shall be involved in the implementation planning of all policy resolutions, unless both the President and the resolution’s primary sponsor(s) at any time agree to bypass the Division.

(b)     Within eight (8) class days of the effective date of a policy resolution, the Director or his or her designee shall arrange a meeting between himself or herself, the primary sponsor(s) of the resolution, and such student government officials or external organizations that either the sponsors, the President, or the Director see it fit to invite. At such meeting the sponsors and Director shall, with the assistance of parties present, develop a strategy to encourage the implementation of the resolution.

(c)      The Division shall conduct such follow-up meetings as it deems necessary for the completion of its coordination duties.

 

§3-6.5. Implementation Advocacy.

(a)      The officials of the Division shall work to advocate the implementation of policy resolutions as deemed necessary through the implementation planning process.

(b)     The Division may relinquish involvement in implementation of a particular resolution to a Department, Commission, or Agency as appropriate to the receiving entity’s responsibilities.

 

§3-6.6. Active Policy Journal.

The Division shall maintain a journal that includes the status and primary implementation contact for every policy resolution not expired or repealed in law or effect. Such journal shall be made available to all entities of Student Government.

 

§3-6.7. Executive Order Appendix.

The Division shall maintain, as an appendix to the Active Policy Journal, a detailed record of all Executive Orders not expired or repealed in law of effect.

 

Part II. Director and Officials.

 

§3-6.8. Director of Implementation.

The Director of Implementation shall be considered a Student Government Official, and shall have executive authority over the Division, and shall specifically:

(a)      Ensure the timely execution of all required implementation planning;

(b)     Coordinate the activities of the other officials and staff of the division;

(c)      Advise the Student Body President on the status of all matters before the division;

(d)     Report on the activities of the division to the Student Senate.

 

§3-6.9. Selection of Director.

The President shall appoint a Director of Implementation no later than the Sunday prior to the final Senate meeting of the spring semester, subject to the majority confirmation of the Senate. There shall be no qualifications for Director beyond those of a Student Government Official.

 

§3-6.10. Assistant Directors.

Without confirmation of the Senate, the President may appoint any number of Assistant Directors of Implementation, who shall be considered Student Government Officials. Assistant Directors shall report to the Director and shall have specific permanent duties relating to an area of policy, as designated by the President.

 

§3-6.11. Division Staff.

The Director shall appoint whatever staff he or she deems necessary for the operation of the division without the confirmation of the Senate. Such individuals must be properly enrolled students, but shall not be considered Student Government Officials.

 

§3-6.12. Terms of Office.

The term of the Director of Implementation shall end upon the appointment of his or her successor. Assistant Directors and Division Staff shall serve at the pleasure of the President and Director respectively.

 

Part III. Limits.

 

§3-6.13. Oversight.

Oversight of the Division may be exercised by the Committee on Government Operations, which shall have the power to review the records of the department, compel report of its members, and to make recommendations to the Director, President, or Senate regarding its improvement.

 

Inserting:

Article 6. Legislative Implementation

 

§3-6.1. Definitions and conventions.

Within this article, the following definitions and conventions shall apply:

(a)     The “Office of the Senate President” and “Executive Office” refers to the Executive Office of the Student Senate President.

(b)     “Supervisor” refers to the Supervisor of Implementation.

(c)     “Policy Resolution” refers to any resolution of the Student Senate that affects external Student Body Policy.

(d)     “Public Act” refers to any enacted legislation of the Student Senate eligible for the veto of the Student Body President.

 

Part I. Implementation Process.

 

§3-6.2. Purpose.

The legislative implementation process exists to encourage collaborative, timely, and thorough action to support and encourage the implementation of the policies of the Student Body.

 

§3-6.3. Coordination of Implementation.

The Executive Office of the Student Senate President shall be responsible for coordinating the implementation of all public acts of the Senate.

§3-6.4. Internal Mandating of Public Acts.

The Senate President shall determine what, if any, Student Government unit has existing responsibility for executing a particular public act, and shall formally notify that unit of the enactment of the legislation. Should no such internal mandate occur, implementation responsibility shall remain with the Office of the Senate President.

 

§3-6.5. Formal Implementation Planning.

(a)     Formal implementation planning shall be initiated on each enacted policy resolution not internally mandated, unless otherwise determined by the Senate President.

(b)     Within eight (8) class days of the effective date of the policy resolution, the Supervisor or his or her designee shall arrange a meeting between himself or herself, the primary sponsor(s) of the resolution, and such student government officials or external organizations that either the sponsors, the President, the Senate President, or the Supervisor see it fit to invite. At such meeting the sponsors and Supervisor shall, with the assistance of parties present, develop a strategy to encourage the implementation of the resolution.

(c)     The Office of the Senate President shall conduct such follow-up meetings as it deems necessary for the completion of its coordination duties.

 

Part II. Implementation Personnel.

 

§3-6.6. Supervisor of Implementation.

The Supervisor of Implementation shall be considered a Student Government Official and a senior member of the Office of the Senate President, and shall specifically:

(a)     Ensure the timely execution of all required implementation planning;

(b)     Coordinate the implementation-related activities of junior staff in the executive office;

(c)     Liaise with units executing public acts following an internal mandate;

(d)     Advise the Senate President on the status of the implementation of all current public acts.

 

§3-6.7. Selection of Supervisor.

The Senate President shall appoint a Supervisor of Implementation no later than the fifth class day of the fall semester, subject to the majority confirmation of the Senate. There shall be no qualifications for Supervisor beyond those of a Student Government Official.

 

§3-6.8. Staff Operation.

The Senate President shall be empowered to designate other members of his or her executive staff as reports to the Supervisor. The Supervisor shall have all common characteristics of a staff member, including term and line of reporting.

 

Part III. Limits.

 

§3-6.13. Oversight.

Oversight of the Division may be exercised by the Committee on Government Operations, which shall have the power to review the records of the department, compel report of its members, and to make recommendations to the Director, President, or Senate regarding its improvement.

§3-11.1. Definitions and conventions.

Within this article, the following definitions and conventions shall apply:

(a)      The “Division” refers to the Division of Internal Affairs.

(b)     “Director” refers to the Executive Counsel and Director of Internal Affairs.

 

§3-11.2. Name and Affliation.

The name of this organization shall be the North Carolina State University Student Government Division of Internal Affairs, and may be simply referred to the Division of Internal Affairs. The Division shall be considered a Student Body Department.

 

Part I. Powers and Duties.

 

§3-11.3. Purpose.

The Division of Internal Affairs shall support the mission and goals of the Student Government by providing support on matters of appointment and recruitment and by offering sound advice on matters of official responsibility and public operation.

 

§3-11.4. Duties.

The Division shall:

(a)      aid the President and other officials with designing materials for public appointments;

(b)     assist the President and other officials with investigating applicants for

(c)      appointment;oversee recruitment efforts for all Executive Branch positions and aid with recruitment for other branches on request of that branch;

(d)     supervise the inflow and outflow of volunteers to Student Body Commissions;

(e)      coordinate the appointment of students to external positions under the direction of the President;

(f)      manage the scheduling of meeting alternates for external bodies with student seats;

(g)      maintain records of the contact information and meeting times for university bodies accepting student representation;

(h)     advise the President and Executive Branch Officials on their obligations under Student Body Statutes.

 

Part II. Director and Officials.

 

§3-11.5. Executive Counsel and Director of Internal Affairs

The Executive Counsel and Director of Internal Affairs shall be considered a Student Government Official, and shall have executive authority over the division, and shall specifically:

(a)      Serve as the Student Body President’s principle advisor on matters of appointment and internal governance;

(b)     Assist the President with the preparation of Executive Orders;

(c)      Liaise with the Senate Standing Committee on Government Operations and together with that body oversee any legal affairs that Student Government may become involved in.

(d)     Coordinate the activities of the other officials and staff of the division;

(e)      Report on the activities of the division to the Student Senate;

(f)      Provide direction and goals for the efforts of the division.

 

 §3-11.6. Selection of Director.

The President shall appoint an Executive Counsel and Director of Internal Affairs no later than the Sunday prior to the last Senate meeting after his election prior to the conclusion of the spring semester, subject to the majority confirmation of the Senate. There shall be no qualifications for Executive Counsel and Director beyond those of a Student Government Official.

 

§3-11.7. Senior Associate Director of Internal Affairs for Recruitment.

There shall be a Senior Associate Director of Internal Affairs for Recruitment, or simply the Senior Associate Director for Recruitment, who shall be a Student Government Official with the duty manage all recruitment efforts from the division under the supervision of the Director. The Senior Associate Director shall discharge the duties of the Director when he or she is unable to do so.

 

§3-11.8. Associate Director of Internal Affairs for University Governance.

There shall be an Associate Director of Internal Affairs for University Governance, or simply the Associate Director for University Governance, who shall be a Student Government Official with the duty to assist the Director in completing the duties of the department as they relate to University Committees. The Associate Director for University Governance shall oversee efforts relating to providing alternates for student members of university committees.

 

§3-11.9. Appointment of Associate Directors.

The President shall appoint the two Associate Directors of Internal Affairs no later than the fifth class day of the fall semester, subject to the majority confirmation of the Senate.

Without confirmation of the Senate, the President may appoint any number of Assistant Directors of Internal Affairs, who shall be considered Student Government Officials. Assistant Directors shall report to the Director and shall have specific permanent duties as designated by the President.

(e)     supervise the inflow and outflow of volunteers to Student Body Commissions;

(f)      coordinate the appointment of students to external positions under the direction of the President;

(g)     manage the scheduling of meeting alternates for external bodies with student seats;

(h)     maintain records of the contact information and meeting times for university bodies accepting student representation;

(i)       keep record of all Executive Orders presently in force;

(j)       train newly appointed members of the Executive Branch on their obligations concerning public operation;

(k)     advise the President and Executive Branch Officials on their obligations under Student Body Statutes.

 

§3-11.5. Executive Information Report.

The Division shall be responsible for maintaining a publicly available Executive Information Report, current to one week prior, including:

(a)     a list of all presently vacant or available positions within the Executive Branch;

(b)     a list of each student representative to a university committee nominated by Student Government, and any vacancies on those panels; and

(c)     all currently in force Executive Orders

(f)      Provide direction and goals for the efforts of the division.

§3-11.13. Executive Historian.

The Director shall designate from within the officials and staff of the division an Executive Historian, who shall gather and prepare the records of an executive administration for submission to the Senate Historian for inclusion in the Student Government Yearbook.

 

Part III. Limits.

 

§3-11.14. Delegatable Appointment Authority.

At no time shall the President or any other official delegate final appointing authority on a public appointment to the Division of Executive Management. In so much as practical, only the appointment non-official positions, such as membership on Student Body Commissions, shall be delegated to the division.

 

§3-11.15. Oversight.

Section 6.        Any individual serving as Executive counsel and Director at Internal Affairs shall become Director of Executive management.  Any individual serving as Senior Associate Director for Recruitment of Internal Affairs shall become Associate Director of Executive Management and Executive Counsel.

 

Section 7.        This act shall be effective upon enrollment.
